Is anti-corruption initiative punishable?

64
Recently, the term “human rights activities” has acquired in our country the tinge of repeated exaggeration or even completely sucking domestic problems out of a finger - to the delight of foreign grantors (to the grantors of the “human rights activists themselves”). More sucked from the finger - get it, sign for a new dollar grant.

For various “voices” and “memorials” the theme of “oppression of rights and freedoms”, as they say, does not leave the front pages. The cat threw the kittens ... If there is no water in the tap ... The message of the material is about one — the rights are in Russia (not that, you know, in the democratic West, and certainly not in megademocratic Ukraine) because they are in vain, and therefore one must either “throw out of this country”, or “change the power”, and one and the other - today, now ...

However, the negative attitude of the majority of Russians to those individuals and desks who call themselves human rights defenders, were also quickly decided to be saddled by individual representatives of the bureaucracy. A whole subclass of Russian officials, who adapted themselves to the new political reality, appeared, so that even those who are ready for quite constructive criticism of their work are ready to declare (new-fashioned Ukrainian) "shpigunami."

An official or an office under his control (which is, by and large, a single whole) is found guilty of fraud or corrupt activities by fellow citizens, including local media — a car is being started, whose gears are spinning for the sole purpose of reducing accounts with those who caught it. Like, how could the most honest of the most honest managers of the housing and utilities department or the city building take from the state, from the people some millions of rubles - yes, all this is a blatant lie, and slanderers - they are not even slanderers, but hired employees of either American or God knows what other diplomatic missions or special services, leading, of course, destructive activities and prevent crystal honest officials to carry out their work aimed at increasing the people's wealth.

Apparently, there were such representatives of the bureaucratic apparatus, riding the wave of popular discontent with the activity of “certain groups of defense workers” in Reutov, near Moscow. Immediately it is worth making a reservation, saying that story, which will be discussed below, has no relation to the direct topic of Military Survey, but when it comes to presumptuous officials who have decided that they are not hired employees, but feudal princes, it would be somewhat strange to ignore the problem. The Reutov team found out about the Reutov case from a well-known blogger Sergey Kolyasnikov (zergulio). Here is link.

The beginning of the story is quite domestic, but its development ...

The thing is that in the town near Moscow there was a man (his name was Yevgeny Kurakin) who decided that the unjustified appearance of doubled and tripled figures in payments for utilities services should not be tolerated. Being chosen for the public position of a senior at home, Yevgeny decided to take up the issue of house maintenance with residential housing companies. Neighbors, seeing that Yevgeny is taking the case very seriously, decided to elect him as the chairman of the Home Owners Association “Parkovaya, 8”. It should be noted that by that time (and it was in 2011), residents of the house already had a negative experience of communicating with the house servicing company, which drew convenient figures in the receipts, explaining more and more new graphs of “increased comfort of housing”. Meanwhile, the tenants "did not observe an increase in comfort," but they saw that even those bloopers who were allowed during the construction of the house were not eliminated.

Yevgeny Kurakin resolved the issue simply - he refused the services of the company servicing the house at that time and entered into a new contract - with the company Veles, which offered much more reasonable prices for services. The numbers in the bills immediately became different, with the savings, the residents managed to elevate the entrances, turning them into truly domestic ones - tiles, flowers, paintings, mirrors, beautiful chandeliers - this is their home, and they pay for living there.

Is anti-corruption initiative punishable?

Then Evgeny Kurakin filed a lawsuit against LLC IC Centrstroy-M, which built the house on Parkovaya, and which is the main developer of the Moscow region city. And, lo and behold! - The court sided with the Parkovaya, 8 Homeowner Ownership Association, and decided to recover a tidy sum for the defects with the IC Centrostroi-M. Decided to decide something, but only the company to pay the money is clearly not in a hurry ...

Moreover, in “Tsentrostroi-M” they quickly realized that something had to be done with this Kurakin, because if the court sided with an individual housing association, it could side with others, because the houses were built with the same same blunders, and, perhaps, with "modifications in your pocket." And law enforcement agencies undertook Kurakin in Reutov. It turned out that against the owner of the housing, encroaching on the "holy" - the SAMU system of construction and utilities - have opened a criminal case on suspicion of fraud. Supposedly, Kurakin did not ennoble the entrances in the way that they needed to be ennobled (apparently, housing and communal services of the Moscow region companies know how to ...), and stole money from "gullible neighbors". They say, yes, it was possible to buy not one but two chandeliers in the corridor of the first floor for those funds that the HOA operated with, and instead of figs and geraniums, put pots with magnolias and orchids ...

Particularly noteworthy is the fact that as witnesses (the accusatory line) in the case of Yevgeny Kurakin, who achieved a reduction in the amounts in the receipts for himself and his neighbors, were citizens who did not pay for housing and communal services for half a year or more. Like, their Kurakin and "robbed" ...

Apparently, the very same Centrostroy-M insurance company in Reutov is being supported by gentlemen from bureaucratic structures who care about the benefits of the population, and therefore, they took up with particular predilection. With regard to a person who really (not in a memorial) defended the rights of the same tenants as himself, a truly blatant preventive measure was chosen - imprisonment. It is incriminated to Evgeny that “he stole all the money of the tenants,” and even organized a criminal group engaged in fraud. Apparently, the investigation is considered a criminal group by the homeowners' association - the owners of OWN housing, for which people paid OWN money. Now Eugene, who was behind bars in 1,5 and was awaiting trial, faces up to 10 years of imprisonment with a fine of one million rubles. This is because the person tried to simply reduce (and reduced) the payment burden for the residents from the structures that sucked to the payment trough! Since August, Yevgeny, under pressure from the public, was nevertheless released under a pledge collected by people, but very soon judicial hearings on the case of the Reutov activist will begin.

The most interesting thing is that aiming the trunk "weapons”, Used to protect the corruption schemes created by them, to an ordinary social activist from the Homeowners Association, local officials and law enforcement officers brought the situation to the point that ultraliberal grant-eaters of all stripes began to stick around. If you look through the pages of publications with materials on the Reutov case, then you can see that the materials already contain local “Navalnists” and “Yabloko”, and who knows who are trying to score their own political points. Such ladies and gentlemen clearly don’t give a damn about the fate of Yevgeny, they are interested in the opportunity to indicate their interest in dismissing charges from an ordinary truth-seeker in order to once again declare that “only Maidan will save this country”. Like, you see, we, in contrast to the current authorities, would not allow this, and therefore it is necessary to "raise the wave" and "go out into the square."

This, by the way, is in many ways reminiscent of the situation in the Chernozem region regarding the preparation for the extraction of nickel in the protected Prikhopyere. If initially citizens were opposed to mining, which could have a negative impact on the ecosystem, for which the fate of the region is really important, then the ultra-left and ultra-right and burdened people decided to take advantage of the situation in order to raise a wave of popular anger with all the consequences for the region and the country. And now at thinned rallies - and belolentochniki, and MMM-sheep, and members of the society of alternative beliefs, etc.

It turns out that some officials of the same Moscow-based Reutov themselves did everything to draw the attention of grant eaters and grant suckers to the situation in the city, in particular in the sector of construction and utilities services. They wanted the best for their loved ones, but it turns out that they themselves are “firing”, and are already ready to start looking for “foreign shpiguns” who “all this was profitable.” This is about what the desire of corrupt officials of various stripes to save by all means and means by means of corruption can lead to ...

"Military Review" is counting on the fact that the court of the city of Reutov impartially understands the case of Yevgeny Kurakin and renders an acquittal verdict, because, based on the facts, it is clearly not sitting on the defendants do, not that ... Otherwise, it turns out that any civil An initiative that leads to a real fight against fraud and corruption will be a priori punishable if there is a bureaucratic interest in the case? As they say, we don’t need such football ...

Often I came across householders in my city and this picture is familiar to me ... actually it’s true .... where the tenants assert their rights and the housekeeper actively conducts his activity, as a rule houses are in good condition .... however some government initiatives sometimes raise bad questions.

"where the tenants defend their rights and the senior in the house actively conducts his activities, as a rule, the houses are brought to a decent condition" - this works only in those settlements where the bureaucratic apparatus is weak or the paws of the housing and communal services are weakly hairy, and in other cases such people are crushed as can up to lethal cases .... Housing and communal services and construction are the most corrupt structures in the country. In the city of Nakhodka, judges receive their 2nd salary from the utility bureaus. And in court decisions they write such crap, but the funny thing is that these illegal court decisions are passed by all instances, including the Constitutional Court. (Personally sued in 2008 and the judge made a decision on the basis of the JK RSFSR 1983, because in modern laws she could not find the "necessary articles", the legality of this decision was confirmed by the Const. Court of the Russian Federation)

Military Review expects the Reutov city court to impartially examine the case of Yevgeny Kurakin and issue an acquittal verdict,

If there was justice, then UD would not have reached the court. Or maybe the judges in Reutov are independent-independent.
If you justify it, then the whole system of housing and communal services in the city will fall, and this is millions.

And our "developed" capitalism is not cynicism in general? Everything will be so, as with this guy (by the way, why are the residents of this house silent in a rag? Coward?), Until social justice and a just social order return to the country. At least a modernized Stalinist state capitalism-socialism. But not the feudal system that is now flourishing in Russia.

You raised a good question. Under the state monopoly on the right, a good percentage of employees from justice is exempted from employment. Under the USSR, the work of a lawyer was not prestigious. Many, practically knowing how they lived under the USSR, can evaluate this as a positive fact.

Why take as many honest officials as you simply need to have for such a large country, if honesty, like this, is punishable even at the level of many families? American - if you're so smart, why poor? - leads to the "habit" of directing the mind not to an honest being, but to a rich being, which gives rise to the need to lie in order to "get rich", proving one's mind. Here the curvature of truth begins in a crooked mirror, built by those who made their meaning of life a number of things completely unnecessary for life.

Officials, we must not take them, they must be fired, replacing their functions with automatic control systems. Not in the 20th century we live. There are enough programmers and computers.

And the official should be appointed only on condition of a higher historical education after passing the State History Exam.

The situation with the housing and communal services is only part of what appeared on the surface, in front of all of us, in view of the fact that the state has decided to shift the maintenance of public utilities onto the shoulders of citizens. This, as they say, is flesh from flesh.

Everything in the world of revolution in the last 300 years ended with the destruction of monarchies and the coming to power of the bourgeoisie, modern liberals. Only one revolution seized power from the bourgeoisie, and called itself socialist. Which is generally confirmed in practice.

If we recall the historical purpose of states, it turns out that the state is an institution for the protection of society and justice. Since it removes the right of the strong against the weak. Under capitalism, the right of the rich, i.e. strong in the constant struggle with the state. And when the state loses, it becomes in the service of the bourgeoisie.

Thus, we come to the crisis of capitalism. Well, for example, the state has ceased to control the banking system. Well, a lot of that.

The modern bourgeoisie comes to power in the process of elective law. Destroys the state from within, the sale of the functions of the state in private hands.

Or do you hope that a competent trained specialist will come after the landed one? he won’t come, he doesn’t need it now any official with a great desire can be made extreme, without errors does not happen in life ..
From my own experience, they changed the alarm, everything works fine, the chief signed the documents and then the inspector pinned down (who worked in the FSIN all his life as it turned out to be a specialist in alarms), unscrewed two boxes, pulled a bundle of wires, stroked the sensor and summed it up with the words "Change everything !! ! ". As it turned out, they did everything inside on twists, but you just need to solder or on special clamps, after half a year glitches in the system would begin. Can a simple official know such nuances of an absolutely unfamiliar question ??? of course not !!!
And by the way, have you ever encountered ordinary citizens yourself? Soooooooo interesting people are ..

Well, what are you talking nonsense. Firstly, you can get there only with education in your specialty. Secondly, you are checked for a criminal record and knowledge of normative legal acts (for administration officials). There are many obstacles and restrictions. I understand that they are effective for a simple person, so that he does not bother the honor of bureaucracy, but still they are.

Why? But very simply, NO ONE wants to work for 8-10 thousands (and this, by the way, is a lot, usually 6-7). with a diploma without experience, smart people leave quickly, the rest work on ...
Regarding education in a specialty, for example, FCS, about 40% are teachers, 30% are former cops / prosecutors / military, the remaining 25 are anything you like including doctors, electricians and foresters, and no more than 3% are graduates of the FCS Academy. Why? who from Moscow will go to Chukotka or in Transbaikalia to the border post recourse where the spit on the fly freezes - for 30 thousand to work ...

Unfortunately, the fight against corruption is a complex process. Corruption, first of all, the system. And the most unpleasant thing, corruption, is the state. Exactly.

I will explain. Corruption is a universal guarantee. System support. By force, administrative methods, corruption can be weakened, or it will grow again.

But those who went to power in the 90s are well aware of the benefits and harms of corruption. Therefore, corruption is likely to lead to zero, alternative methods. The benefit of corruption is when the bureaucracy, at the extreme moment of the weakening of the state, is linked by a system of bribery. Thus, the state was able to keep GDP, after EBNa.

Corruption is all sorts of intermediaries, solvers, this is "I know one guy here", etc. Corruption always has two participants: the taker and the giver. Don't let the corruption disappear.

local officials and law enforcement officers brought the situation to the point where ultraliberal grant-eaters of all stripes began to cling to the case

Let not the topic. I have repeatedly written in the comments that the activities of officials cause such discontent among the population that it is not even necessary for the State Department to spend money on NGOs to shake the situation in our country, they (officials) themselves, by their action and sometimes inaction, shake it better than any NPO and the State Department combined, which the latter enjoy and enjoy.

    Something like that. hi

Just touch our officials! You immediately become a "human rights activist" (in a bad sense), grant eaters, falsifiers, swindlers and slanderers. An article will soon be introduced - if you touch the power, you will be a "terrorist" and "extremist". The country lacks a normal INDEPENDENT press and media We have some in the hands of officials, others to oligarchs, and still others are begging in foreign embassies. And the second is NORMAL FAIR elections, at all levels. And then the voters will receive normal information, they will choose whoever they need. , excuse me, but they haven’t come up with anything better than democracy. It has shortcomings, but they are identified and solved! I AM NOT FROM "RAIN" and NOT A FRIEND OF MAKAREVICH! No. hi

What elections are there ?? If only those who pass, everyone would come and vote for anyone, but not for EP and the current guarantor, then maybe at least something would move. And then comes 20-25 percent, so it can change something.

We must forget the word HONEST in understanding the voluntary agreement.

You need to be able to motivate so that actions from hopelessness are honest.

Any bourgeois country will eventually come to socialism in an evolutionary way. Question sooner or later. According to the principle of Khoja Nasreddin. Or donkey will die or governor. Or who is there, I don’t remember.

Dear, take it higher, I wrote more than once, all this is a "vertical of power", well, housing and communal services cannot brazenly steal separately from the authorities, everything is seized everywhere, there are a lot of examples, only the high-profile arrests of mayors and governors confirm this, I'll tell you the 90s are resting in comparison what is happening now, the site will be closed faster than they will be allowed to figure it out to the end and punish those responsible

Hello everyone. I have been reading articles and materials on this site for a long time, but somehow I had no desire to register and write a comment. Until today I have not read this article about Yevgeny Kurakin. Here's what I want to suggest, let's create a petition in defense of Eugene. And this will be our real support for him. We can write here a LOT of words of support and the address of Eugene, and curses against housing and communal services and law enforcement agencies (by the way, whose rights do they protect, these "law enforcement officers"?) But this will not change the situation! Only pressure on those who started it, only the maximum resonance can save Eugene from the deadline. I often sign petitions on the website www.change.org, and with tens and hundreds of thousands of signatures, we have already saved more than one fate, including positive decisions on release from prison. I myself have never created a petition, but I can try, if only for this there is more information about the case against Evgeny. Can the author of the article help with information, maybe where is the case file? In general, an attempt is not torture, but an eighth will not give a good person the fate of finally ruining! And yet, do not consider it an advertisement (although what kind of advertising is there), but go to https://www.change.org/impact, register, and sign at least a few petitions to which you are not indifferent. The authorities must know that we see and understand what they are doing, or with their connivance. We do not need the Maidan, but we must not be silent either. Words of condolence, support, indignation will not solve anything, voices are needed.

The initiative is good and kind. But, do you know who owns this site? I don’t want to sound paranoid, but this enticement was created by our 'favorite' SGA. And, as it seems to me, only so that according to the petitions that are there to know in which direction to push. Petitions must be signed live on the streets. And all these sites are only as 'statistics' of discontent, and a method of manipulating people.

To get started (I think you haven't done it yet), visit the site and see how many people in Russia have already helped. I don’t know about you, but I personally think that it won’t leave me if I vote for Eugene’s help. By the way, I found a ready-made petition, and voted.

they planted and? then what? and then - a girl came from the street and works, the question is how? because nothing doesn’t know ANYTHING at all ..

Do not confuse a manager with a specialist with a narrow profile, this surgeon can only be replaced by a surgeon, and the official must follow the law, job descriptions and common sense ...
It’s just that the vertical of power in the country is built in such a way that each (significant) official sits on a strong hook, and therefore is controlled ... The authorities do not need honest officials, they cannot be manipulated ...

      common sense ??? !!! Well, well ...
Under the current provisions, we are obliged to give the individual an order (squeezed out a piece of the yard from a neighbor) .. BUT exclusively during WORKING TIME, and as luck would have it, he works at that time fellowHe does not receive mail, does not refuse to receive — which would be ideal for us and the court, but simply his wife tells the postman — he does not live here and the order is returned due to the absence of the addressee. We can’t attract him for the non-presentation of documents — no passport data - The FMS, referring to the secret, does not allow us to provide a drive; the police need his passport data ...
When trying to hand in outside working hours, he runs to the prosecutor’s office and rolls complaints about us, after which we are ©
The violator is absolutely not a thief and not an oligarch, an ordinary hard worker who has mastered the technology of sending far, far ...

It seems to me one such a short description of the ennoblement process that is crafty? It would be nice to reveal the topic of who the contractors are, by whom and how the financial side of the issue is framed, there is not enough subject for reflection.

The fact is that many people, acting in good conscience, think that this is clear to everyone and they don’t take a lawyer, and the most elementary lie is a common thing for organizations. It should be clear that if the company has a lawyer, he sued a lot once and having experience can easily defeat a person without experience.

Something the author either confused or kept silent - under 159 of the Criminal Code of the Russian Federation, arrest does not apply until a court decision. on this occasion, there is a resolution of the Armed Forces of the Russian Federation, it came out in the year 2010 approximately.
And the case is brought not for the fact that someone did good to someone, but for the fact that somewhere he did something illegally. It is likely that he began to press defaulters, and since there is no intelligible legal mechanism on this issue, it may have crossed the line. This happens, unfortunately, well-intentioned too.
