One of the key declarations of euromaidan was the following: we (gathered on Independence) for the rule of law! Off the corrupt cops! Atu prosecutors bribe takers! Down with corrupt judges! The law must triumph!

But when looking at what is happening now, a lot of questions arise about the “rule of law” and the “rule of law”, which is established in the country after the victory of the “pro-European democrats” from the Maidan.

We have already written about what unconstitutional arts the Verkhovna Rada has allowed itself at the time when the Basic Law was being audited, the president was removed from power and new rulers were appointed “from the Maidan” (“So what are the actual claims against Yanukovych?” No. XXNX (9 ) from 691 February - 28 March 6 g.). We will not repeat, let us say about other aspects of this full-blown problem - total lawlessness and lawlessness, in its scale considerably exceeding all that was “before Maidan”.

"The law is one for all." This slogan of the Maidan (originating from 2004, is known as “implemented” in practice in 2005 — 2009, when the very forces that organized euromaidan were in power), I believe, everyone heard. The question is: is the law the same for everyone — for the “heroes of Maidan” too? Or do they not fall into the “all” category? Is “one for all law” applicable to them?

"Before the law, all different." And this thesis is surely familiar to everyone. But the question is: are everyone equal before the law - are the “heroes of Maidan” too? Or are they somehow “more equal”?

Every day, one or another representative of the new government tells how “under the guise of self-defense of the Maidan,” some gangs are repairing looting - committing robberies and violence against citizens. A categorical reassurance “to take measures” and “to stop looting” sounds. It is emphasized that “real self-defense”, they say, doesn’t do anything of the kind, but is on guard of order.

But why is not a single marauder, who is mobbing “under the guise of self-defense”, detained or presented to the public? As long as the new authorities do not present, and with arguments in their hands, they do not prove that this is really “under the guise”, citizens have every reason to believe that these are not some kind of disguised NKVA agents (in which other “historians” it is customary to shift the crimes of Bandera - the analogy with what is happening now suggests itself), and those very “heroes of the Maidan” who felt complete impunity and permissiveness.

But there are also situations where it cannot be argued that someone engages in looting and commits other crimes “under the guise of self-defense.”

For example, February 26 Verkhovna Rada deputy Gennady Moskal said that in Kiev and a number of other regions of Ukraine, armed gangs are actively operating under looting and looting.

According to the people's deputy, they are represented by hundreds of euromaidan and other public organizations that took part in the revolution. Moreover, "their actions today are no different, and even much worse than the actions of the overthrown regime."

Thus, according to the information spread by G.M.so.kk.a.la.em, representatives of 31 and 33, hundreds of self-defense of Maidan, are especially defiant. Pay attention: not "under the guise of self-defense Maidan" -but directly to the members of this self-defense.

“31-s hundredth is headed by Sasha Bunker, and 33-i is armed with 10 Kalashnikov assault rifles. In addition, an unknown organization of the UPA "Special Forces" appeared, which is armed with almost 20 firearms weapons and 9 Kalashnikov assault rifles, - says Mr. M.so.k.k.a.l.b.

He also reports that one of the active parts of 31 and 33 “Travels by car with the numbers of the Verkhovna Rada of Ukraine AA 0019 BP”.

"At night, these people shoot at populated areas with firearms, behave provocatively and inadequately. During the day, citizens from different regions of the country continuously call me with the only request - to save them from armed criminals. Therefore, law enforcement agencies that are obliged to protect the rule of law do not react to the calls of the victims and do not go anywhere, ”Moskal said, adding that these people are armed with firearms, Kalashnikov assault rifles, pistols, grenades and pieces of hunting rifles.

“Under the slogans of the revolution, these groups robbed abandoned houses, take away jewels, valuables, as well as alcoholic drinks, which they drink on the spot, then shoot with firearms, throw Molotov cocktails and even rape women and girls who did not have time to escape,” - confirms M.o.S.S.A.L. He also said that these groups of people in masks with bats, firearms and edged weapons move freely in Kiev and other regions of Ukraine. "They stop vehicles, mock passengers and demand money, ostensibly to support the revolution."

Named concrete hundreds of self-Maidan. Even some names are named. Named car number. Why is there no reaction from the law enforcement authorities from the new government? After all, crimes from the category of particularly serious!

Of course, in the context of the above-mentioned Mr. Moskal, what these hundreds of self-defense are, is called into question (and this, to put it mildly) widely replicated (by politicians from the Maidan, supporting them by “free media”) that on the Maidan were entirely supporters of peaceful and non-violent actions, advocates of European values, who were hurt in every way by the "evil Berkutovtsy".

On the other hand, the message of Gennady Moskal is the answer to the question (more precisely, one of the answers, in addition to the destroyed monuments to Lenin, anti-Russian slogans actively voiced on the Maidan, repeal of the law on the basics of language policy, etc., etc. .) why residents of the south-eastern regions do not perceive euromaidan with its declarations - which remain so declarations, but in practice they are completely different.

Representatives of the Maidan (and I’m not saying this, deputies from the “promoted” factions admit it) rob, burn, rape-no reaction from the authorities! At best, promises to “rein in”. But after all, it is not about “reinserting” speech — but about punishment for the crimes committed! To the fullest extent of the law.

Or a gangster attack on the house of the KPU leader’s son. Although in a recent interview with 2000, Pyotr Nikolayevich insisted, they say, that it’s not worth paying much attention to “his” trouble - because now hundreds of people have become victims of such arbitrariness. Nevertheless, I take this particular example and here is why. The moment when the marauders were engaged in their black work was recorded on video cameras (even journalists were invited to this “heroic action”!), On the same day, many Internet sites made their brands and car numbers that received this gang: “ Audi ", Mr. AX 1908 CX; Mercedes AA 0430 MT and Chevrolet AI XI NUMX BE. What are the problems with law enforcement to install intruders? Yes, no! There would be a desire. But the latter, apparently, is missing.

And against such a background - verbiage about the selfless struggle of the new government "for the triumph of justice." Who needs these slogans that are not supported by deed?

When representatives of the new government have to explain themselves to the press in the context of the aforementioned “weirdness” (facts and evidence, and often directly the names of looters, but law enforcement officers' reactions do not), they respond with something like “time is”, they say, the law enforcement system is destroyed (and who destroyed it and on what legal basis ?!), it is demoralized, they say, there is no one to patrol the streets, no one to engage in investigation and detention.

But this is, firstly, the problem not of citizens, but of those who rushed and seized upon the authorities (they are not able to ensure order - collect, as they say, things and fail on all four sides). Secondly, even now there are those to whom to investigate and whom to detain!

Say, February 26 is then also acting. Prosecutor General Mr. Makhnitsky said: The Prosecutor General’s Office is investigating the abuse of power by the traffic police regarding the restriction of citizens' rights. As he explained, we are talking about traffic police officers who, during the period of mass rallies starting from 21 in November 2013, “made illegal reports on the commission of offenses and made decisions on these cases”. “This is primarily about avtomaydane. This is a falsification of traffic police officers of the protocols, as a result of which citizens were deprived of their rights, ”Makhnitsky stressed.

In addition, according to him, investigations have been initiated against prosecutors who “took a biased legal position in criminal proceedings” regarding participants in mass meetings. He added that judges who rendered unlawful decisions on falsified cases against protesters will also be brought to justice.

And the Kiev lawyers Bashuk and Didovets supplemented Mr. Makhnitsky: they achieved the dismissal of the prosecutor of the Obolonsky district Andryushchenko, his first deputy Golub and deputy Kluge, who petitioned for the arrests of the “prisoners of Grushevsky”. "At the request of the former prisoners, they all wrote resignations," the UE quoted them as saying. Those. the investigation has just begun - whether the prosecutors had a “biased legal position” or not, whether they were engaged in fraud or not - and the sentence had already been passed by the “prisoners of Grushevsky”!

As we can see, there is someone to investigate the facts of the alleged violation of the law - when it comes to the affected "heroes of Maidan" - to investigate even such trifles (as compared with robberies, arson, rape, illegal possession of weapons, etc.), such as traffic police reports.

February 26 on his page on Facebook then. Minister of the Interior (and now the Minister) Arsen Avakov reported: "The perpetrators of the abduction of activists Igor Lutsenko and Yuri Verbitsky were detained by the head investigative department of the Ministry of Internal Affairs."

Or, 28 February, the press service of the Prosecutor General’s Office reported on the detention of a serviceman suspected of abusing Cossack hundred Maidan member Mikhail Gavrilyuk. And the Kiev Pechersk District Court promptly worked (the same court, whose verdicts were recently called into question by representatives of the Maidan): elected a law enforcement officer suspected of abuse of power, which was accompanied by violence, painful and other actions insulting the personal dignity of the injured Gavrilyuk, the measure of restraint in form of detention. How to call what is happening? May be, selective human rights protection - guaranteed only to “heroes of the Maidan”?

It was mentioned above that three prosecutors of the Obolon district of Kiev were forced to write a letter of resignation. This process of mass lustration - even before the adoption of any law on this account - takes place everywhere in the regions controlled by the “heroes of the Maidan”.

It is known how it happens: “heroes of Maidan” with bits, or even machine guns, break into the premises of the police, prosecutor’s offices, courts - and force “corrupt officials” to write statements about leaving “of their own will.” Of course, these statements are legally insignificant, since compiled not voluntarily, but under duress - moral and physical.

But it would not be more logical for the Maidan authorities to begin with themselves - with the cleaning of their own ranks. For starters - from the marauders. To at least have the moral right to proclaim high matters from the stands and television screens.

In general, the big questions to the current actions of Themis, controlled by "representatives of the people" - with bats, and even machine guns. In Rovno, Sashko Bily, such an activist of the Right Sector, came to the meeting of the presidium of the Rivne regional administration with a Kalashnikov assault rifle - demanding that the authorities in the region be fully lustration (see video on censor.net.ua). He also visited the local prosecutor, who was slapped in front of the cameras and told him how and what to do (see video - kp.ua).

Interior Minister Arsen Avakov called it “bestiality” and promised to take action. "Bestiality"? Yes, this is the most real crime, the responsibility for which is provided for in part ch.2, article xNUMX of the Criminal Code - “deliberately causing beatings to a law enforcement officer”. I'm not talking about such "little things" as illegal possession of weapons. Where is the reaction of law enforcement agencies under the new government?

But we are talking about this fact because it has become publicly known - Sashko Bily is not ashamed of anyone and commits illegal acts right in front of the cameras. And how many similar facts are not recorded on the camera?

What kind of justice under the supervision of such “sashkov bilykh”? After all, what is the difference - iniquity is created because the investigator-prosecutor-judge took a bribe, or because the investigator-prosecutor-judge is under physical and moral pressure? In both cases, the decisions rendered are unjust.

I would like to draw attention to the statement of the current Prosecutor General Mr. Makhnitsky from February 24 (when he was still the so-called authorized representative of the Verkhovna Rada to monitor the activities of the prosecutor's office): "The case of the beating of students, which was closed under the amnesty, today proceedings were initiated in this criminal case. This article provides for responsibility for obstructing a peaceful assembly and rallies through the use of violence, and questions are being resolved regarding the violation of these cases on the grounds of terrorism. ”

They were referring to the events on the night of 29 and 30 on November 11, 2013. All those involved in this and many other incidents were amnestied by the law of the Verkhovna Rada. And for the first time in stories Ukraine canceled previously announced amnesty. In essence, the law, contrary to the Constitution, had retroactive effect. And again, selectively, the amnesty was canceled only in relation to those who were not on the side of euromaidan.

A dangerous precedent has been created. I would like to remind in this plan to all those who today, driven by a thirst for revenge, go to such steps: with time, the situation may change, and then don’t be surprised if the amnesty / rehabilitation for the protesters will also be canceled. With all the ensuing consequences for the now amnestied / rehabilitated - the statute of limitations for those articles (and there are a number of especially grave crimes) that they were accused of large (however, if you can trample the previously announced amnesty, then why not limitation of a crime?).

February 26, however, the Prosecutor General Mr. Makhnytsky sent a letter to all Ukrainian prosecutors in which he demanded to release and rehabilitate all participants of mass protests. According to his order, prosecutors "must rehabilitate those who have already been convicted, renounce charges in cases that are tried in courts, and close all proceedings that have not yet been transferred to the courts." And separately in this letter, Mr. Makhnitsky pointed out “The impossibility of prosecution for the overthrow of monuments to persons involved in the organization of the Holodomor”. Translated into a common language - it is an exemption from the responsibility of those who destroyed the monuments to Lenin. Those. vandalism - if committed by representatives of the Maidan - in Ukraine is now "legalized" by the letter of the maydanny Prosecutor General! Even despite the laws in force! Here is such a gloomy pun.

How would it be interesting to react in Western Ukraine to the fact that if groups of opponents of euromaidan made raids on their regions and massively destroyed the monuments to Bandera and Shukhevych there? This, so to speak, the new government question on the backfill. And one more thing: how, in such circumstances, does she (the new government) intend to keep the country's unity? Where is the guarantee that tomorrow vandals will not begin to bring down the monuments to Lenin and other leaders of the Soviet period? No guarantees! Responsibility for vandalism - in relation to nemadannym characters - no!

Selective justice. How many pretentious matches have been said on this topic in the past four years!

By the way, if someone has forgotten, then by "selective justice" meant the criminal prosecution of the "former." That's when law enforcement agencies in 2010 began to press accusations against members of the Tymoshenko government — a storm arose: selective justice! And it was also called “reprisals against opponents”, “persecution of the opposition”, “political repression”.

But now massively open criminal cases against the "former". Let me emphasize: I don’t want to say at all that they (Yanukovych, Klyuev, Pshonka, the former governor of Cherkasy region Tulub, etc., etc.) have nothing to show and nothing to answer.

I'm talking about double standards. Why in 2010-m criminal cases against the "former" - it was selective justice, the violation of democracy, political persecution, and the same thing in 2014-m - the triumph of justice? Where is the PACE, the European Parliament, the US State Department, human rights activists of all stripes? These Messrs, at least, explained: why then did they raise a cry to the whole world, and now they are silent?

Or The West protects from selective justice too - selectively? Those. only "their". Are these European values? ..

Selective justice suggests selective prosecution. This is exactly what is taking place on the part of the new Maidan government, not only with connivance, but with the direct assistance of Western "mentors in democracy and the rule of law."

I don’t know how anyone, but personally, I constantly hear the rumors of the statements of representatives of the new authorities, including security officials, politicians (both Maidan and those who “got under” the new government), journalists about the “criminal orders” that the previous government gave, about the execution of these very “criminal orders” by police officers, first of all “Berkutovtsy”.

But let me tell you, the fact that the orders were really “criminal” still needs to be proved. And only the court - and no one else (!) - can establish that the orders were just such - criminal. Only the court can dot the “i” - who and to what extent has violated the law and whether it has violated at all.

However, without waiting for the completion of the investigation (not the court), everyone is talking about “criminal orders”. And where is the presumption of innocence? Or, with the victory of the “European values” of the Maidan style of this concept, it no longer exists in Ukrainian law?

The West introduces some sanctions against those who "gave criminal orders." In addition, “corrupt officials” have been appointed without trial and investigation — against whom sanctions are also being imposed in Europe and the USA.

Once again, I’m not trying to defend or question anyone that any officials involved in corruption offenses. But one way or another, the procedure stipulated by law - the investigation, the verdict of the court - must be observed, and even then we declare Ivanov-Petrov-Sidorov corrupt, with all the ensuing consequences.

There are other questions to these "black lists" (in particular, the Swiss and Austrian). First: why only now in Europe did they decide to fight Ukrainian corruptionists? The second is: why are there not a single Ukrainian oligarch on the lists, including those who were close to the previous government - fabulous states made money with the help of ex-officials? Third: would someone in Europe initiate the prosecution of Ukrainian corrupt officials from the former government, if in November last year an association agreement was signed with the EU? Fourth: why in Europe there is no desire to understand the possible involvement of euromaidan representatives in corruption offenses, including from among those caught up in the new government? .. And this series of questions could be continued. But is it worth it? It may be easier to give one answer to all questions at once: approaches to the fight against corruption in Europe are not legal, but political (geopolitical).

And the last. Every day, new heads of law enforcement agencies, Messrs. Makhnitsky and Avakov, report on the opening of criminal proceedings (which already dozens, if not hundreds) of abuse of power and unlawful actions of police officers against protesters.

For example, only 24 in February, Mr. Makhnitsky announced that more than 50 suspects were involved in the mass shooting of peaceful demonstrators. “In the case against the first state officials and law enforcement agencies for organizing mass killings, suspicions about 50 will be publicized, among them the top law enforcement officials,” he said from the rostrum of parliament. Later the circle of suspects only expanded.

I do not argue. Those of the law enforcement officers who really violated the law should be responsible for what was done.

But. And those who used force against police officers, who killed them (and dozens of law enforcement officers died and hundreds were injured in clashes with euromaidans), who pushed "peaceful protesters" to these actions should also be held accountable for their crimes. But something not to be heard that the investigation into the facts of the murder and the harm to the health of the employees of the Ministry of Internal Affairs, in particular, and the "Berkut" was carried out, it is not reported that a suspicion notice was given to someone, and all the more so that someone was detained or arrested. Or murderers-if they Maidan-discharged indulgence?

The approach is inadmissible: those who were on the Maidan and supported the Maidan are completely representatives of the "good", who were on the other side of the barricades - the "evil".

The text of the agreement of February 21, signed by President Yanukovych, the leaders of the opposition, “signed by” the European mediators, stated in the paragraph 4: “Disturbing the violence will be conducted by a separate monitoring of the government, for the sake of Europe”

Although this agreement has now been turned into a piece of paper, it would nevertheless be appropriate to recall paragraph 4. The investigation of the events that took place, in particular the facts of the death of the protesters and policemen, should be carried out in the most objective and politically unbiased atmosphere.

If only the appointees of the new government judge and pardon, if everything is accompanied by moral and physical pressure on the police, the prosecutor’s office, the courts, and witnesses, in such circumstances there is a low probability of conducting a comprehensive, complete and objective investigation, there is little chance that the perpetrators and innocent) will be installed, not appointed.

Among other things, all that has been said has a direct bearing on the problem of preserving the territorial integrity of Ukraine and the country's unity, which is so urgent today. Residents of the southern and eastern regions, and previously not perceived euromaidan, are now only convinced that they are right. It is unlikely that someone will be deceived by life with such “European values”, under the conditions of such a Maidan “rule of law”.
