Andrei Filichev, Deputy Plenipotentiary Representative of the President of the Russian Federation in the Siberian Federal District, summed up disappointing results: the most difficult situation in this direction was in the Novosibirsk region.
Here, the number of unfinished objects, according to different sources, ranges from 45 to 59, and even to 80 (!), And the number of defrauded real estate investors varies from 4,5 to hardly 8 (!) Thousand people. For comparison: in the Irkutsk region today almost 2 thousands of affected citizens. 26 homes are not commissioned. In the Omsk region 22 "problem" building. 2 needs thousands of 300 victims.
And, finally, the problem of the deceived co-investors in the republics of Tatarstan, Altai, Tyva and Khakassia, as well as in the Kemerovo region, the Republic of Buryatia and the Altai Territory, is completely (!) Missing. Successfully resolved this issue in the Kaliningrad region. From which it follows that if the regional and municipal authorities qualitatively execute the laws and their duties, they will not receive regular walkers in the form of defrauded co-investors in the reception rooms.
Who erected unfinished construction in Everest in Novosibirsk?
The volume of unfinished construction, and, consequently, the number of defrauded real estate investors, has increased in Novosibirsk every year over the last 15 years. The most amazing thing is that this process took place simultaneously with the triumphant reports of the regional and city authorities on the growth of housing construction.
It turned out to be a very interesting paradoxical picture, when, against the background of the growth of the well-being of some citizens, other citizens were forced to crowd in reception offices at various levels of officials in order to achieve justice and, finally, to get an opportunity to move into apartments they had honestly bought.
It should be noted that the avalanche-like growth in the number of defrauded real estate investors fell in the period from 2000 to 2014 the year when the current governor Vladimir Filippovich Gorodetsky held the post of mayor.
It was during his leadership in the Siberian capital that the “glorious” followers of the Moscow billionaire Polonsky, recently arrested in Cambodia, appeared, who, according to investigators, committed a large-scale fraud during the construction of the Kutuzov Mile residential complex in Moscow and having collected more than 5,7 billion rubles from participants of the shared construction of the residential complex "Kutuzov mile", made unhappy ... 110 citizens.
I just want to exclaim: oh, Mr. Polonsky, would you go to Novosibirsk, do you have this scale? There are thousands of such people in the Siberian capital, and you only have 110 ...
At first glance, on such a gigantic scale of the Novosibirsk problem of deceived real estate investors there are two reasons: unscrupulous developers, prone to fraud and trustworthy outrages of real estate investors, who voluntarily lend themselves to the ingenuous tricks of schemers.
But this is not at all the case, because according to the Federal Law of the Russian Federation of 6 in October 2003 N 131-FZ "On the general principles of the organization of local self-government in the Russian Federation", chapter 3, article 14, local issues include "planning development of the settlement territory, territorial zoning of settlement lands, establishment of land use rules and development of the settlement territory, withdrawal of land plots within the settlement for municipal needs, including through redemption, implementation of land control over the use of land settlement "(p. 20).
In other words, the municipality is responsible for everything that happens in the field of development and construction. And if unfair developers turned out to be admitted to the housing construction market in the period from 2000-th to 2014-th year, and even fraudsters and schemers, even on such massive scales as it happened in Novosibirsk, then there is no doubt that there is no way purely.
In other words, this delicate, invisible to the eye of ordinary citizens, the process did not do without the extremely skilled managers of the former mayor’s office during the leadership of the current Novosibirsk region’s governor Vladimir Gorodetsky, the former head of the construction department and architects of the Novosibirsk mayor’s office, and now the minister of the same region’s construction, and others members of that cohesive team ...
Fruitless attempts to rake the "Augean Stables" of unfinished construction
The realization that the process of deceiving citizens in the housing issue has gone too far in Novosibirsk seems to have come to the local authorities and law enforcement agencies when it acquired an avalanche-like uncontrollable character.
The number of criminal cases on such precedents began to grow:
--- well, in Novosibirsk, the investigation was completed and the scandalous case of the director of the construction company SUMET Vladimir Zurkov and the chief accountant Elena Ekimova, accused of embezzling more than 800 million rubles from equity holders, was brought to court. Almost 1 thou. Co-investors left without paid housing, the developer promised cheap apartments to them.

- In July, the 2014 of the Year, the Zheleznodorozhny District Court of Novosibirsk pronounced a sentence on the case of the housing cooperative "Derzhava", in which victims there are about 190 people. However, neither the founder of the cooperative, Yuri Kotlyarov, nor his wife Larissa, disappeared in time abroad.

Concerning other participants of the criminal group, the investigation is not over, the prosecutor's office reports. Last spring, the head of Neograd, Vladimir Aksenov, was arrested.
By the way, following the results of 2013 in Novosibirsk, 9 objects were completed, in which 846 equity holders received housing. In 2014, 14 houses for deceived real estate investors were completed in the city.
Simple calculations show that at such a pace for many deceived co-investors there are very real prospects for re-issuing ownership of their apartments to great-grandchildren, and maybe even great-great-great-grandchildren, since there are no real effective mechanisms to solve this problem. Moreover, even those methods that at the very least allowed at least somehow complete the long-term construction projects and provide people with desired housing were eliminated.
We are talking about changes to the Land Code, enacted from 1 March 2015, by Federal Law FZ No. 171 “On Amendments to the Land Code of the Russian Federation and Certain Legislative Acts of the Russian Federation”.
Swan, cancer and pike, or who in the forest, who for firewood?
The same governor of the Novosibirsk region Vladimir Gorodetsky commented on the consequences of the innovations best of all:

Now the amendments to the land code made this scheme illegal, free land allocation to legal entities from 1 March was banned, and, therefore, thousands of defrauded real estate investors not only in Novosibirsk, but also across the country stood in suspense: what next?
After it became clear, the Novosibirsk parliament came to its senses, which plans to appeal to the State Duma in the near future with a proposal to cancel a number of recent amendments to the land code - they deprive the hope of deceived real estate investors in the 15 regions of the country, including Novosibirsk areas.
Andrei Panferov, Deputy Chairman of the Committee on Construction and Housing and Public Utilities of the Legislative Assembly of the Novosibirsk Region, told Vesti-Novosibirsk: “Otherwise, we will return to our original positions, we will again look for ways out of this situation, and 6 thousand and a half people now they are left without an apartment - they will not only be outraged, they will just stay at the broken trough. And in the state in which it is, this issue will be solved for years. ”
Meanwhile, the society is still waiting and will not wait for an answer to the question: what did the governor, the mayor and deputies of all levels from Novosibirsk and the Novosibirsk region actually do when this law was prepared, discussed and adopted? Really there was no opportunity to prevent such a development of events?
And now the mayor of Novosibirsk, Anatoly Lokot, has so far unsuccessfully forced to look for ways, how to clean the “Augean stables” of long-term construction, which were created long before him ...
By the way, who just did not try to raze them up: among them there is a well-known anti-corruption activist, State Duma deputy from the United Russia party Alexander Khinshtein, who specially visited Novosibirsk, and the deputy minister of construction and housing and communal services of Russia Leonid Stavitsky.
Most interestingly, the last one almost a year ago stated the following: “The Novosibirsk region is one of the leaders in housing construction and issues related to the modernization of engineering networks, the construction of new networks, issues related to energy saving. We are monitoring the situation in the country, we see how the development of the regions is proceeding, and we have an understanding. Very pleased with the availability of master plans approved, they provide an opportunity to plan work. Our priority is a social focus, primarily in housing construction, and this is seen in the administration’s plans in implementing our programs ... ”
How everything combined with the sorrows of thousands of Novosibirsk citizens, already losing hope of getting their own, already purchased housing, is probably only known to the Lord God. And, probably, to this deputy minister ...
The recently elected mayor of Novosibirsk, Lokot, has repeatedly stated that solving the problems of deceived real estate investors is one of the priorities for the development of Novosibirsk in 2015 ... Based on the analysis of the current state of this issue, based only on facts, it is highly likely that the mayor has changed priorities and this is explained by the circumstances of the so-called “force majeure” in the form of amendments to the Land Code ... However, this is no easier for deceived real estate investors.
The residential estate “Zakamensky” is already boiling ...
During that same visit to the Novosibirsk region, Leonid Stavitsky paid special attention to the situation with the deceived real estate investors, he even visited the “Zakamensky” housing estate - the most famous Novosibirsk unfinished project.
“The most important thing,” said Stavitsky, “is that the administration knows what to do with it.” This small nervousness is more on emotions, but I am pleased that the work is being done, and not just the light at the end of the tunnel is visible, but clearly defined terms, ”said Stavitsky. - The house is not built in a month, people need to explain, convey messages to them. In principle, the same thing is everywhere, all problem objects have the same complex of questions, and they are solved all over the country. ” “I am sure that in Novosibirsk this will all be decided within two years. 2-2,5 of the year, and this issue will be closed, there is no doubt, "- said the deputy minister.

This becomes most clear on the example of the residential estate “Zakamensky”, where about 1,5 of thousands of defrauded co-investors joined together. In comparison with this figure, the frauds of the previously mentioned billionaire Sergey Polonsky and his 110 are deceived by real estate investors in rattles in the preparatory group of the kindergarten for underdeveloped children.
So, Neograd-Invest LLC was the developer of the Zakamensky microdistrict, which it began to build in 2006 year, when the governor Vladimir Gorodetsky was the mayor of Novosibirsk.
More than two years ago, the shareholders of the microdistrict appealed to the head of Novosibirsk with a request to influence the developer. In the microdistrict, only one multi-storey building was put into operation, and the company undertook to build five more, contracts were concluded with more than 1,9 thousand citizens. In September, 2014 of the year, at the request of the equity holders, the court declared the construction company Neograd-Invest bankrupt. By the way, thus the hope of successfully completing the construction after this is virtually gone, because in modern Russia, bankruptcy in 99 cases from 100 does not lead to future prosperity, but to complete ruin and subsequent collapse.
To complete the construction of houses "Zakamensky" neighborhood need to invest about 1,5 billion rubles.
There are investors willing to raise these funds. Moreover, with the rational use of already tested mechanisms, the problem of defrauded real estate investors in Novosibirsk could be solved in 1,5 - 2 of the year. And to make happy owners of new housing almost 10000 people, as was done in other regions.
However, it seems that at all levels of government the solution of the problems of deceived co-investors ends not simply with the issuance of regular portions of promises, but, on the contrary, with the adoption of such legislative norms that make it possible not to fulfill these same promises.
It is about the introduction of new rules of the Land Code, associated with the prohibition of the allocation of new land plots to legal entities to compensate for the investor’s costs, and after that the process of housing construction for deceived co-investors rose firmly. Among businessmen there are no people willing to donate billions of rubles without a donation. And this is quite understandable.
Meanwhile, among shareholders of the residential estate “Zakamensky”, as well as among other citizens of Russia who have fallen into a similar situation, mass discontent is ripening. They will not fail to take advantage of the forces that are asleep and see how to “shake” the situation in Russia. In particular, this will not fail to use the so-called "non-systemic opposition", which has recently become frequent in Novosibirsk: both Mikhail Kasyanov and Alexey Navalny do not stint on the enticing promises, and in Novosibirsk they were literally given the "green light".
Considering the fact that Novosibirsk defrauded real estate investors already went out on the street with slogans and hung out banners like “Putin, help”, “Zakamensky - City of homeless people, Putin, help” and the like, the leaders of the “non-systemic opposition” may not be particularly difficult to take advantage of Novosibirsk defrauded real estate investors, created by officials and all sorts of scammers. Moreover, now the opposition are sleeping and seeing how to provoke people to spontaneous unrest, and so earn credibility. As the experience of the so-called “orange” revolution shows, it is the initiative and small groups of the population that play the main role in them. And why are deceived real estate investors not suitable for such a role?
Another question is that business and moral reputation, that Mr. Kasyanov, that Mr. Navalny no. But because they have no choice, not to try to use the legitimate indignation of people. And after a single day of voting in September 2015, when city and regional deputies will be elected in Novosibirsk, both United Russia and the Communist Party of the Russian Federation will analyze for a long time, how did it happen that thousands of defrauded real estate investors and their family members became pawns in their hands “Non-systemic” opposition? And they did not give their votes to them.
As a conclusion: as a rule, when leaders make mistakes, ordinary citizens turn out to be extreme. But then, sooner or later, it is necessary to bear the responsibility of those who made the wrong decisions.
