The State Duma of the Russian Federation is preparing amendments that will return the full confiscation of property to the Criminal Code

122
Deputies of the State Duma of the Russian Federation consider the amendments, which will return to the Criminal Code (CC) the full confiscation of property as a separate punishment, reports "Independent newspaper". In addition, to combat embezzlement and bribery, the Criminal Code proposes to introduce an article “sabotage”.

The head of the KPRF legal department, Vadim Solovyov, stated that as a result of a sociological survey of convicted officials, it turned out that they were most concerned about the complete confiscation of property. According to him, the decision to enter it "for the embezzlement of state and municipal property, as well as for bribery," appeared after the arrest of Khoroshavin's funds.

“We realize that if we do not make the appropriate changes to the code and do not return the confiscation, then the overwhelming majority of the property that he had found during the searches will be returned to him,” he said.

The return of the institution of confiscation will also help to eradicate corruption, a member of the State Duma Committee on Civil, Criminal, Arbitration and Procedural Legislation Yuri Sinechshchikov and Deputy Chairman of the State Duma Committee on Security and Anti-Corruption Dmitry Gorovtsov also said.

Anatoly Vyborny, a member of the State Duma Committee on Security and Anti-Corruption, also noted that at the moment Russian officials have “blurred functionality”.

“It is important for us to raise the legal culture and form an anti-corruption model of behavior,” he stressed.

I begin to believe in miracles, although I am afraid there will be such amendments that the wife to whom everything was copied is not obliged to prove her innocence.
In short, we’ll wait and see how it really will be. Even I do not believe our deputies. I probably have a phobia laughing

If you wish, you can put anyone. As the saying goes, there would be a body, but a case could be found. Here you need clear rules of the game. On the one hand, minimize the loss of society from the inefficient use of public funds. On the other hand, do not kill local initiative. The situation when the local leader does not take responsibility and ANY question is resolved through Moscow is no better.
Everyone understands that any manager always takes risks when making decisions. Which is better: helping young mothers or senior citizens? Or it might be better to invest in the development of individual farms.

It is with such thoughts that they continue to steal bureaucrats, knowing that they can and will give a term (often conditional), but the money stolen will remain! Impunity, actual, only contributes to ongoing corruption and theft! Only confiscation! Other - empty concussion.

I allow myself to disagree, now the embezzlement is practically derived from the criminal law, therefore, it is very difficult to give a real term. Moreover, the execution, we have an unlimited term moratorium on the death penalty.

And here is how the president has been "fighting" corruption for 16 years:
                2000
“We just need a persistent, consistent and principled fight against corruption. I must say that this is one of the most important state tasks in the direction of making our country economically attractive and politically developed. Without the fight against corruption, no progress in the economic sphere is possible, it will not be. And therefore, this has been and remains one of the state’s top priorities. ”

                2001
“We will work to strengthen market institutions, and toughly counteract corruption.”

                2002
“An important task is the suppression of irresponsibility, abuse of power, and even more so corruption.”

                2003
“No country has a chance to fight corruption and develop efficiently if it cannot speak directly and openly about it and start an open struggle.”

                2004
“We need accurate and realistic measures - both in the fight against manifestations of corruption, and, most importantly, in its prevention.
“The authorities in Russia have repeatedly and loudly declared the need to fight corruption, whole programs have been developed, and some rather tough steps have been taken, but let's say directly: they, unfortunately, did not give a big effect”

                2005
“The roots of corruption are not in good or bad people. They are in the system. ”
“We will definitely move in this direction, strengthening both the effectiveness of the state and the work of law enforcement agencies, which are called upon to fight corruption in practice, in practical life.”

                2006
“Corruption is such a thing that, unfortunately, is inherent in modern society. But this does not mean that this should not be fought. The level of corruption may still be different. And with us today it is unacceptably high. ”

                2007
“The business climate in the country should be reliably protected from corruption, from crimes in the economic sphere. Such crimes, if they go unpunished, corrupt the society, inflict a serious blow on Russia's reputation as a country with a civilized economic environment. ”

                2008
“There is no pill for corruption that I took and recovered; there must be a system of measures; there must be a legal system of measures and a repressive one.”
“Now a group of experts is working on this, and we will definitely adopt an anti-corruption law.”

                2009
“There are results in the fight against corruption, and if we constantly hammer this point, we will work in this direction, and efficiency will increase. And vice versa, if you do nothing, don’t talk about it, it will only get worse.

                2010
“We will consistently carry out anti-corruption work, severely punish unscrupulous officials, continue to“ clean ”the legislation, and eliminate the very possibility of corruption.”

                2011
"We will fight corruption in a consistent, persistent and tough manner, campaigning is unacceptable here."

                2012
“In the fight against corruption, we will go to the end, regardless of the face, and within the framework of the law.”

There are fifties, but bureaucrats will begin to hide money more actively in foreign banks (otherwise they will suddenly accept it). I would also introduce such a rule that officials would report not only on incomes, but also on expenses. Although, Luzhkov’s example shows that an official can be a goal like a falcon and the law is crystal clear. The main thing is to have a wife --- a brilliant businesswoman. But you can also be mother-in-law, children, brother-in-law. There is someone to entrust the stolen ...

This is good, but you also need to consider the property of relatives of such embezzlers. As practice shows, for the most part, officials rewrite all property to relatives, while they themselves seem to be poor. I consider it necessary to check relatives and establish where they got this property from!

Yes, there would be a desire to apply the law. The Criminal Code has rules that allow at the stage of a preliminary investigation to arrest objects that are an instrument of crime, obtained by criminal means, etc. What is applied?

What were you happy about? They will come to you and confiscate, not from officials. Not a single car factory remained in the country, only screwdrivers. But on all channels they are worried that "our" car industry has sunk. They are tempting the population with preferential car loans. Young immature souls will take credits. The government will announce another crisis. The federal bandits-collectors will come to those who collected the loans and describe the property.

It’s also not bad for everyone who is involved in mega-projects in our country, for the funds in these mega-projects, to conditionally condemn this article before being approved for the post. That would not be, as in the East. He closed the project without corruption, the article is being removed. He didn’t close, in which he came, in that he left. Everything else is in favor of the state. And by the way, the question about relatives remains open, will this article concern them?

It's just like a song. The initiators are all from the "opposition" factions. Well, we need to show them somehow that they are oppositional. And everything will be fine with them. They will not suffer materially, because firmly convinced that the initiative will not work, and gullible voters will see that they are for justice. From the message more amused by the "wisdom" of the head of the legal service. His knowledge of law is not much different from the knowledge of other representatives of the authorities, who carry illiterate nonsense from the screens. If he hadn't skipped lectures, he probably would have known that the law increasing punishment for those who committed crimes before its adoption does not apply, and Khoroshavin can sleep peacefully.

If such a law is adopted, it is definitely brought to the Maidan a certain group of the population. Over the past years, a class of large owners has formed in our country. These are usually cynical, unprincipled, decisive people. They will do everything for theirs. Recall the events of the Civil War in our country. They will be supported by world capital, because private property is the basis of their universe. Such a law is most likely not to be adopted or it will be a broken law.

The head of the CPRF legal service, Vadim Solovyov, said that as a result of a sociological survey of convicted officials, it turned out that they were most afraid of the complete confiscation of property.

It is strange that this could not have occurred to the legislators before, without conducting opinion polls of convicted officials. For what, then, all these corruption schemes are being developed by bribe-takers, is it not for the sake of profit, without even being afraid of criminal prosecution, knowing that after getting out of prison he will have everything that he has acquired by "back-breaking labor" existence for a long time for sure. Somehow, April began surprisingly strangely, which is not news, so balm for the soul. laughing

Honestly, it's disgusting to look at fuss, namely fuss, with officials, bribes. It is clear that officials are also trying to restore order in their home. And it is not surprising that we are witnessing an unhurried run of taxed units that are stagnant and indifferent to their work.
If they, and the deputies, would like something effective, then at least turn to the experience of recent years.
Previously, close relatives could not be directly, and, in some cases, directly subordinate. Well, this is the administrative side of things. In the current socio-economic formation, an administrative resource is only a lever, and the tool lies in the economic plane.
Who prevents the introduction of rules prohibiting relatives of government officials who make economic decisions from running their business in the territory controlled by their relatives. In other regions, please, but near by a relative - no, no?
Nothing prevents this. No, one thing hinders - the feeling of profit among the state themselves, who can restore order. Therefore, it is not necessary to broadcast from the television box in unshakable and confident voices about what you do not want and will never do.

It’s not about the relatives ... Relatives will leave, there will remain godfathers, friends, friends of friends ... Here a systematic approach is needed. In my opinion, the measures that have already been taken are more than effective ... a 100-time fine and an 8-9 year strict worker. The punishment is sufficient. Now it remains to limit the possibilities and desires to pull or take. And for this, it is necessary to clearly distinguish between powers, functions and responsibility for the work performed. Responsibility is not only criminal, but also political and, most importantly, moral. It is necessary to try to revive the institution of public censure. Let them know that if they took or stole, all relatives, friends, colleagues of the wife, classmates of children and so on will know about it.

Let me remind you: 1) Decree on the criminal non-prosecution of the ex-president and members of his family... and 2) Decree of the President of the GDP." On the acquisition of Sibneft shares (owned by R. Abramovich - the wallet of the EBN family) With a market value of $ 127 million, they (shares ) were bought for $13,2 billion with Gazprom's money. And one more thing. Is no one surprised by the amazing unsinkability of the red-haired bastard Chubais? Well, if you consider that it was Chubais who “employed” GDP, after Sobchak came under investigation and GDP remained unavailable in business

So you look at the current sanctions for bribery. A fine of 100 times the amount of the bribe is not like candy wrappers... Take a million, pay the state a hundred. Confiscation alone will not solve the problem of corruption. If we solve the issue as a whole, then after the proposal to return the money to the homeland with a subsequent amnesty, every shock worker of capitalist labor during the accumulation of capital should clearly see the specter of prison, loss of rights and confiscation of property acquired by back-breaking labor. An additional incentive could be an offer to countries where corrupt officials keep money (the competent authorities have the data, believe me) to confiscate these savings if sources of income are not confirmed. Yes, Russia will lose several hypothetical tens, even hundreds of billions, but the obvious export of capital will stop. I think that doing business in the country will immediately become easier.
