So what do we have? At the moment, approximately the following: The World Anti-Doping Agency (WADA) has begun the process of depriving the Russian Anti-Doping Agency (RUSADA) of authority and relevant status. The reason for such severe sanctions was the alleged inconsistencies in the database of the Moscow Anti-Doping Laboratory, transferred to RUSADA as part of a previous investigation. Then, I remind you, this was one of the conditions for lifting sanctions from RUSADA and the entire Russian Olympic sport. But, as usual, something went wrong ...
An important point: we are talking about the discrepancy between the database and the “original” already had by WADA, supposedly “merged” by an unknown informant. In the database provided by our authorized persons, WADA experts found some traces of corrections and inconsistencies. And they relate, of course, to the positive doping tests of Russian athletes. Say, it used to be, this information is in our sample base, and the Russians gave us a dummy. Punish!
So far, however, a loophole has been left for sport from RUSADA and Russian officials: they have been given a three-week deadline for submitting "explanations." The final decision should be made on October 23. And most commentators are wringing their hands in hysteria now: maybe there is at least some explanation ?!

So far, from the “explanations” only the traditional “I am not me and my horse is not mine” has been found. More specifically: for some time the bases were at the disposal of the Investigative Committee of Russia, no one knows for sure what they did with them. Maybe they cleared that up, but we are not to blame, let us go to the Olympics!
Another argument is absolutely in the same vein: the Moscow Anti-Doping Laboratory is a separate legal entity, does not directly report to RUSADA, and therefore “we don’t know anything, ask Rodchenkov” and so on.
Strictly speaking, if we were dealing with normal justice, all this story would not be worth a damn. Firstly, a reference to some anonymous database with which someone is checking there is completely unauthorized. Who transmitted it, under what circumstances, why the court should consider it a reliable source of information ... Only these questions would be enough to completely destroy the charges built on such a shaky basis.
But we are not dealing with normal justice, but with sports. Let me remind you that there is even a special international sports arbitration: an athlete who feels infringed on something has no right to appeal to a regular court, but only there, otherwise he may be disqualified. The same can be said of federations - national or sports.
But there are precedents for athletes to appeal to ordinary courts. And the precedents are successful: Bosman’s case, for example. In 1992, the Belgian footballer Jean-Marc Bosman, who had an expiring contract with the club, through a regular court, obtained the right to transfer to another club (after completion of the contract) without paying any compensation to the former employer. One of the inviolable rules of European (and world) football was not just violated, but instantly and fundamentally destroyed: since then, relying on this court decision, any European football player can freely move from club to club if the current contract has ended .
A similar situation was with restrictions on the number of foreign players in European clubs - only the threat of judicial sanctions made UEFA recognize all players with EU citizenship as “their own”. Before that, I recall, in each championship there were separate limits on legionnaires who had the right to simultaneously enter the field. And even earlier there was an even tougher limit on foreign football players who can be hired (as they say in the sports environment, “sign”) in one club. By the way, the Russian footballer Igor Simutenkov was also involved in the abolition of this rule, who was tried for four years because of this restriction.
That is, no matter how officials from various sports organizations puffed out their cheeks, courts of ordinary jurisdiction have an unconditional priority over decisions of the Sports Arbitration Court in Lausanne. It is clear that this case is “muddy”, like any judicial casuistry, but another thing is obvious: in a situation of egregious arbitrariness and neglect of the rules of the right to appeal to the Sports Arbitration Court, it no longer makes sense: they will decide anyway as the main directors of the series “Russia” want at the Olympics under the white flag. "

There probably is no point in linking the intricacies of the near-sports legal system - all the same, we won’t be able to figure this out to the end. Moreover, there are almost no hopes for a fair decision on this issue. Rather, we should nevertheless draw some conclusions that have long been asked, but which for some reason we were shy or afraid to draw ...
First of all, the most obvious conclusion: you can never trust "partners". If they give "iron" guarantees and really want to believe, see paragraph one.
In addition, it is very likely that WADA may indeed have a certain “base” of the Moscow Anti-Doping Laboratory. Yes, we can doubt its reliability, but the thing is different. It seems that they are playing very seriously against us in this field, with the involvement of special services. And you need to answer in the same way: to get the base of American and English (as well as Norwegian and even more than any) athletes who have the so-called "medical exceptions." And then, on the basis of these data, arrange international scandals, demarches in the IOC, in WADA, demand the disqualification of Norwegian “asthmatics”, tennis players of the “Williams brothers”, American gymnast Simone Biles and other happy owners of outlandish diagnoses that allow them to legally train and compete , pumped up with horse doses of the most real, forbidden for all other doping.
In general, it's time to stop "being good" and patiently endure slaps in the face. After all, what a wonderful chance there was to ignore the Olympics in Pyeongchang - the results are all the same degrading, you could safely not go there at all. But no, the hysteria deployed in the media and the well-known liberalism of the Kremlin led to the prevailing position of the athletes: they say, we trained, we have to go.
And they went. The absolute majority - in order to dishonor their country. On ours, dear readers, money.
It is very strange that the authorities do not understand the harmfulness of such a policy. Although in part it can be understood: after the ban, many of our “sports hopes” would throw a tantrum, change citizenship, and go to Korea under any flag, even under the Ukrainian one. And this is also a blow to the well-being of the nation, to the authority of the authorities and the state.
But the loyalty of our most patriotic athletes is a slightly different question. Let's not talk about sad things, when everything is already very sad ...
In general, it looks like it's time for us to switch to “non-parliamentary” methods. And if an anti-Russian decision is nevertheless made, there will be no more humility: refusal to participate in any form, refusal to purchase broadcasts, prosecution in the Basmanny court ... And this is not a joke of despair, this is a little that we really can do in legal plan. And after how many years we will be able to arrest and take to Russia to serve the sentence the defendants in the case, the tenth question. Maybe in a decade, but let them live this decade with a sense of neighborhood with Russian bunks and convicts ...
Alas, I myself understand that it is unlikely that our “responsible comrades” will decide on something like that. Again, months of humiliation, requests, attempts to agree, some excuses ... And the customers of this action do not need anything else: give the Russians an excuse, and they will inflict a dozen slaps on their own ...
