The struggle for the observance of the rights of reserve and retired servicemen is escalating. Veterans with increasing activity write to various authorities up to the president of the country, demanding an elementary - the implementation of the Constitution of the Russian Federation, the previously adopted law "On pension benefits for those serving in the military ..." And what about the State Duma? How do people's deputies care about the rights of their voters?



The State Duma, as it became known to the "MIC", began to move before the summer vacation. The most responsible deputies attempted to abolish the degrading 0,54 coefficient, authorizing weaning of people in shoulder straps for almost half of the deserved retirement pension. A corresponding bill was prepared. However, his fate was deplorable.

Voiceless majority

The draft, which provided for the abolition of the discriminatory coefficient, was introduced by State Duma Deputy VI convocation Vyacheslav Tetekin. But even at the discussion stage, the Government of the Russian Federation and, oddly enough, the State Duma Committee on Defense, headed by Vladimir Shamanov, spoke out. The conclusion, signed by Deputy Prime Minister Sergei Prikhodko, who heads the government office of the Russian Federation, said: when reducing pensions from 100 to 54 percent, the legislator was guided by the fact that the calculation of military pensions from January 1 of 2012 is based on the new, higher money allowance and this ensures their an increase of 50 – 70 percent. Starting from 1 in January, 2013 has established a mechanism for a phased annual increase in the amount of the money allowance taken into account when calculating pensions. In addition, Prikhodko noted, "the government of the Russian Federation provides for an annual increase in these pensions by two percent above the inflation rate." And the implementation of the bill proposed by the MP Tetekin will require an increase in federal budget expenditures by 500 billion rubles a year.

Probably, Mr. Prikhodko did not serve in the army, because otherwise he would not give such conclusions. In fact, this provision of the law has practically not been working for two years now and everything has been going on to sway it at all. Why then did they even adopt the law “On pension provision for those who did military service ...”, in every possible way advertising deputy care for people in uniform? By the way, almost all the last years, real inflation in the country was more than six percent, and no one took this into account.

I note with regret that the bill to abolish the notorious 0,54 coefficient was proposed to deputies just on the eve of Defender of the Fatherland Day - the voting in the Duma took place on February 22 of the year 2017. The document was No. 631118-6 and was called “On the recognition of the second part of the second article 43 of the law of the Russian Federation 12 February 1993 of the year No. 4468-1“ On pension provision for persons serving in the military, in the internal affairs bodies, the State Fire Service, drug and psychotropic substances control agencies, institutions and bodies of the penitentiary system, and their families. ” Everything in it is extremely well-founded and weighed. It was a good reason for people's choices in fact, and not in words to take care of the defenders of the Fatherland. Unfortunately, after counting the votes, the draft did not receive a quorum. Supported the proposal of all 19 deputies. Against and abstain - 0. That is, the 431 dumac did not vote at all. Eloquent testimony to how popularly elected representatives are indifferent to the fate of the defenders of the Fatherland.

At this next election, we should think hard not only to pensioners of the Ministry of Defense, but also to all servicemen, along with their family members, representatives of the Russian Guard, FSB, FSO, and other law enforcement agencies. I don’t name the names of the deputies and the factions to which they belong, so that on the eve of the presidential elections we don’t politicize the situation once again. The conclusion of 9 February 2017, signed by the first deputy chairman of the State Duma Committee on Defense Andrei Krasov ("United Russia") refers to the same motives. The deputy chairman cites an iron, as he believes, argument about the ratio of military to average civilian pension, which has increased in favor of the military by 1,8. And the increase in military pensions proposed by the author of the draft law leads to an even greater gap with civilian ones and not only will not ease social tensions, but will also cause its growth, the deputy argues. In addition, according to Krasov, in modern socio-economic conditions, the possibility of such a sharp increase in federal budget spending on these goals seems at least controversial.

What can I say? Taking care of saving state funds and talking about social justice is good. But a few questions arise.

First, the beaten thesis about the excess of military pensions over the average civil one in 1,8 times looks reproachful of those in power to the people in uniform - we are wholehearted to them, and they grumble. In that case, let me ask you: maybe it's not a big military pension, but a humiliatingly pitiful civil pension? Of course, it is a shame that after working all his life, a simple person today receives mere pennies on which one can not live with dignity. But this is not the military to blame, they did not make the life of our old men almost unbearable, but the ruling elite, that is, the same government officials and lawmakers. And let's not forget - it was a decent retirement pension that has always been a significant argument for someone who, when he was young, chose a military path.

Secondly, Andrei Krasov admits in his conclusion that there is social tension in society due to low wages and pensions. But then what are you doing, gentlemen, to prevent such tension? Are you seriously discussing bills banning sex with prostitutes and excluding drinking scenes from movies?

Thirdly, shouldn't officials and deputies like Prikhodko and Krasova try out simple arithmetic calculations and find out the correlation of their monthly salary with the average pension and salary in the country? Or the incomes of such “effective managers” as stolen millions and the VIM-Avia management who escaped abroad? This is where you can think about social justice and budget savings.

This is not all, there are fourth. The introduction of the reduction factor from 2012, taken into account when calculating the military pension, and the further freezing of indexation for some reason did not apply to the following categories of pensioners and their families (Section 6 Art. 12 FZ No. 309):

judges of the Military Collegium of the Supreme Court of the Russian Federation and military courts;

prosecutors (including military prosecutors);

employees of the Investigative Committee of the Russian Federation (including the military investigating authorities of the RF IC);

federal government civil servants.

What is the reason for such a selective approach? What is the ordinary judge honored deceased in Syria, General Valery Asapov?
That is why Vyacheslav Tetekin and hundreds of thousands of military retirees, persons equated to them rightly believe that applying these restrictions only to them really leads to an increase in social tension, contrary to the Constitution of the Russian Federation and Russian legislation.

Improper mechanism

Recall once again: real inflation in Russia lately, except for this year, was about seven percent. Thus, even with a two percent increase, the purchasing power of military retirees is reduced by 1 / 20 annually. It turns out, on the one hand, the state recognizes that veterans of military service and law enforcement agencies should receive a pension at the level of the average monetary allowance. On the other hand, he declares that they have no chances for justice before 2035.

Citizens who are subject to the proposed provision for abolition of the provision of the law, carried the necessary for the state and dangerous to their life and health services. The proposed bill could eliminate the existing imbalance in the volume of social protection measures, would restore justice to veterans, reduce the level of social tension, at least in this segment.
In the definition of the Constitutional Court of September 24 2012 No. 1800-0, it was noted that the change in the size of certain monetary payments should be carried out in such a way that the principle of maintaining confidence in the law and the actions of the state is respected. But there is no trust. There is a law that must be implemented, and not to look for loopholes, how to get around it, and excuses for this.

In connection with the numerous appeals of the officer and veteran publics to the legislative and executive authorities, judicial instances, the Public Chamber of the Russian Federation 13 of June 2017 of the year presented for discussion at the round table the question of the fulfillment by the state of social guarantees for the payment of pensions to military servicemen, as well as law enforcement officers and their family members (initiated by Anton Tsvetkov, Chairman of the RF Commission for Security and Cooperation with POC). The root of the problem is the discriminatory coefficient 0,54. In 2012, in fact, a tax on military pensions in the amount of 46 percent, which is levied including on veterans and invalids of the Great Patriotic War, which does not fit the standards of morality and morality, was introduced, which is not stipulated by law. The Constitutional Court of the Russian Federation, verifying the constitutionality of Part Two of Article 43 of the Federal Law No. 4468-1 on the appeal of military pensioners, recognized the so-called reduction coefficient corresponding to the Basic Law only on condition of establishing the appropriate compensation mechanism (definitions 1433-O of 17 July 2012 of the year and No. 1800-O from 24 September 2012 of the year). But the proper mechanism has not worked for five years.

Over the years, regulatory legal acts of the Russian Federation have suspended from January 1, 2013 on January 1, 2018 of the following pension provision rules for military service personnel (as well as service in the ATS, GPS, drug control agencies, institutions and bodies of the UIS, Rosgvardia), and family members:

indexation of the monetary allowance of military personnel and military pensions in accordance with the rise in prices for consumer goods and services;
the monetary allowance is taken into account when calculating pensions from 1 in January 2012 of the year in the amount of 54 percent and from 1 in January of 2013 th annually increases by two percent to achieve 100 percent of its size (indexation);

Taking into account the level of inflation, the Federal Budget Act indicated the annual increase can be set for the next fiscal year in an amount exceeding two percent.

As a result of the suspension of the above legal provisions on January 1 2017, the military allowances and military pensions have depreciated by more than 44 percent. The purchasing power of salaries for five years has fallen by more than a third. To return to the situation that was on 1 January 2012, they must now be increased by almost 50 percent.

It is quite natural that for five years now there has been a struggle between the officer and veteran publics for the restoration of justice. The Communist Party of the Russian Federation, the Union of Soviet Officers, the Movement in Support of the Army, the Defense Industry and Military Science take an active part in it. It would seem, which bells should still be beaten in order to hear the government, the State Duma? Or there the enemies of the state have already entrenched themselves, who are just waiting for the protests to spill onto the streets.

The participants of the “round table” in the Public Chamber of the Russian Federation noted that further preservation of the reduction factor for military pensions would increase social tensions and could lead to mass demonstrations by the officer and veteran community. But you can still fix the situation. It is only necessary to understand that those carrying military service perform constitutionally significant functions, which determine their special legal status, the content and nature of the duties of the state towards them. The need for military personnel to perform assigned tasks under any conditions, including those with significant risks to life and health, as in Syria today, entails the obligation of the legal system to guarantee social protection that is adequate to the special status. 1. To entrust the deputies of the Communist Party faction in the Committees of the State Duma of the Russian Federation on defense, security and anti-corruption, labor, social policy and veterans' affairs, budget and taxes, civil society development, issues of public and religious associations, the State Duma Commission on consideration of federal budget expenditures to ensure national defense, security and law enforcement, to prepare in a short time and to introduce a bill on the abolition of the discriminatory coefficient 0,54. 2. To involve in the preparation and discussion of the bill deputies from other factions, the officer and veteran community, especially the Union of Veterans of the Armed Forces, the Committee of War Veterans, the Union of Officers of Russia, the Union of Soviet Officers, DPA, military lawyers, journalists, the media covering this topic.

3. To widely cover the preparation and content of the bill in the party and other available media, social networks.

Representatives of the Ministry of Defense, the Ministry of Internal Affairs, the Investigative Committee, the General Prosecutor’s Office, the Ministry of Emergency Situations, military lawyers, and other competent specialists took an active part in the round table in the CP of the Russian Federation. There were two video links with the Primorsky Territory and the Voronezh Veterans Organization. In the speeches, people insistently demanded that the coefficient be removed and thereby eliminate wild injustice.

Representatives of the Ministry of Defense of the Russian Federation and the Ministry of Internal Affairs told how they work on this issue, prepare applications, request funds for the articles. But each time they run into misunderstanding and closed doors of the omnipotent Ministry of Finance, where the answer is one: there is no money. “It's amazing, there are money in the state for various kickbacks and huge salaries for mediocre footballers, but there is no decent life for servicemen who have devoted their health and strength to the defense of the state,” says the main military adviser to the chairman of the Central Committee of the Communist Party of the Russian Federation Igor Belozertsev. “Calls for no money, but you hold on!” Can go on forever. Moreover, by introducing various amendments, the government may indefinitely freeze or delay the work of an already adopted law.

According to Belozertsev, in the near future it is required:

develop and introduce for consideration a new draft law, taking into account the necessary amendments;

seek an appropriate decision of the Constitutional Court on the issue of the 0,54 ratio, referring it to the legislature’s department if they have not developed a compensation mechanism;

to raise the officer and veteran public (unions, committees, officer assemblies, etc.) to fight for their legitimate rights;
organize the direction of mass lawsuits to the courts with the requirement to return stolen from military retirees, and this is hundreds of thousands of rubles.
People still do not understand that everything has come up against the blank wall of official indifference, and it is no longer possible to pierce it with moans, letters, and complaints.

If a broad protest wave does not rise on the ground, the current anti-army bog in the State Duma will continue to spread stench and rot.
