On this day, only a few gathered at the monument to Telman, in fact, if everyone who did not have legal housing provided by the Ministry of Defense did not have enough space in this square and all the streets in the district, only those who have the right to residence in the city of Moscow.
History the problem is this: on the order of the Ministry of Defense of the Russian Federation, the general contractor SU-155 undertook to build four housing complexes by the fourth quarter of 2014, with a total of 60 houses. 12 houses should be erected on Bolshaya Ochakovskaya Street, 15 should be built in the Molzhaninovo microdistrict, in the Khoroshevskoye Highway area - 13 buildings and on Left Bank Street - 23 houses.
By now, it has been fully commissioned and only the microdistrict in Bolshaya Ochakovskaya is settled. Three more houses were not completed in Molzhaninovo, only two buildings were commissioned in the Khoroshevskoye Highway area and three more are planned to be completed in September of this year. This is not to say that the Ministry of Defense is not fulfilling its obligations to provide permanent housing for officers discharged to the reserve, the fact is that this process is proceeding in accordance with the queue formed by the Department of Housing Support (JO) from those in need of housing and in accordance with the internal instructions of the military. But it so happened that part of the waiting list was assigned to apartments in houses at the above addresses, and they, naturally, were taken out of the waiting list for housing. The general contractor (SU-155) went bankrupt, construction work at all four sites stopped. The trouble is that, in violation of all existing rules, builders received an advance payment in the amount of 95% of the cost of all construction and installation works. Since this money has already been mastered by the bankrupt general contractor, the military department does not have other means to complete the construction of houses at these four sites, further work is proceeding with a big slip. At some point, the obligation to complete construction was undertaken by the Open Joint-Stock Company “Main Directorate of Arrangement of Troops” (OJSC “GUOV”), but it did not cope with this, the lack of funding eventually becomes a stumbling block. As a result, people dropped out of the housing queue and did not receive apartments, while the next ones waiting for them were already moving into houses built by other contractors.
MOLZHANINSKY CONTRADICTIONS
The smallest district of the city of Moscow - Molzhaninovo - is located outside the Moscow Ring Road, almost within the northern part of the city of Khimki, and closely adjacent to the territory of Sheremetyevo International Airport. Here in 2014, in general, the construction of a residential neighborhood for military personnel was completed, its address is determined on the Internet as ul. Sinyavinskaya, possession of 11. Just in this neighborhood 15 houses. These are the buildings of the standard series I-155MM, I-155MK and several experimental towers of the project I-155НБ. By now, most of the houses are inhabited. The neighborhood, houses and the surrounding area are on the balance of the Ministry of Defense. The utility support for the houses is provided by the notorious management company OAO Slavyanka. Let me remind you, not so long ago 25 criminal cases were combined with the name of this company, united in one proceeding. The media published information about embezzlements through this organization worth more than 4 billion rubles, in which its previous leadership took part, at that time it was still a limited liability company. The new CEO decided not to change the name of this business structure, only the form of its ownership was changed, that is, it became a joint-stock company.
The retired officers who were provided with housing in this microdistrict noted a number of significant shortcomings in its location. Firstly, it is built on a part of the territory of the Podrezkovo industrial zone and production facilities are located in close proximity to it. According to sanitary rules and norms (SanPiN), housing should not be built here, but only objects of production and culture. There is information that in March 2011 of the year Moscow Mayor Sergei Sobyanin informed the Minister of Defense about this fact. At that time, the head of the Russian military department was Anatoly Serdyukov.
Secondly, the neighborhood is bordered by the old, but still operating Cherkizovsky Northern cemetery. Again, according to the requirements of SanPiN, “the sanitary protection zone is an indispensable element of any industrial enterprise and other objects that can be sources of chemical, biological or physical effects on the environment and human health.” At a minimum, for the construction of residential houses, the general contractor had to take into account the sanitary protection zone and carry out soil recultivation - neither one nor the other was done.
Thirdly, and quite significantly, the high-rise buildings of this microdistrict were built in the dangerous zone of take-off / landing of the planes of Sheremetyevo International Airport, without the consent of the latter’s management. It has been documented that at one time the Arbitration Court of the city of Moscow ordered the collection of a fine from SU-155 for this violation. Moreover, there are SanPiN requirements limiting housing construction near airports, airfields, and heliports related to air pollution with harmful substances and excess noise, vibration, and electromagnetic radiation.
There is a precedent in the judicial practice of the Russian Federation when the Volzhsky District Court of the city of Saratov admitted that the developer illegally erected two 10-story buildings near the airport without the consent of its owner - aviation SarAvia enterprise. As a result, the court ruled on the demolition of these houses, since they were located in the danger zone of aircraft take-off and landing and interfered with the operation of the airport's radar complex.
To make the picture appear in full, it is worth quoting a paragraph from a letter of the waiting officers addressed to Supreme Commander Vladimir Putin: “Sheremetyevo is building a third runway where heavy planes will land, now the noise level exceeds acceptable standards, and it will be even worse” .
The second building of this microdistrict is made according to the standard design of the I-155NB (the developer of SU-155), this is the 25-floor tower, taking into account the technical floor. And after the completion of construction and installation works, this tower gave a heel, naturally, they did not settle in it. The regulars who received apartments in it, when he was a SU-155, Mikhail Balakin, a representative of this organization, said that because of poor-quality geological surveys for some reason unknown to builders, the building leaned more than it was provided for by standards. Since the conclusion in the form of “unknown reasons” indicates a clear incompetence of the representative of the general contractor, we had to ask for comments on the current situation at the Production Research Institute for Engineering Surveys in Construction (PNIIS).
A specialist from PNIIIS explained to me that most likely at the base of the foundation were soils with different compressibility. In the monograph of Academician of RAS V.I. Osipova indicated that their presence is characteristic of this territory: from weakly to highly compressible (from moraine loam to fluvioglacial sands, peat and peaty ground). Also characteristic of this area is variability in their horizontal strike. Probably, the foundation of this building fell on the soils of different compressibility, which gave a different draft, resulting in a roll. But the expert made a reservation that without additional investigation of the true causes of the roll of the building did not determine and it is quite possible that it arose because of the builders' mistakes. The opinion of this expert, of course, can be trusted, PNIIIS in Soviet times was the main institution of the USSR Gosstroy, and now it has unique, rich scientific archives (most of which are still classified). Currently, it is put up for sale by the Federal Agency "Rosimushchestvo", that is, in fact, this institution is awaiting liquidation. I am afraid that in the near future in Russia there will be no organizations capable of conducting high-quality engineering and geological surveys for construction and correcting the numerous mistakes of insufficiently competent design and survey companies and construction organizations.
In addition, the neighborhood on Sinyavinskaya Street (possession of 11), where the settlement is already taking place, is still not connected to a permanent power supply system. CONSTRUCTION QUALITY
The persons who were present at the picket at the monument to Ernst Telman spoke of serious complaints about the quality of construction of residential buildings in the above-mentioned residential districts. Installation of panels in almost all houses was done extremely carelessly, in some places the builders installed them, mixing up and down, interpanel joints filled with large gaps, significantly exceeding the permissible construction standards.
During the construction process, technological violations were made that could lead to the partial destruction of the supporting structures of houses under construction with unpredictable consequences. In some houses, the heating system was completely defrosted. Neighborhoods on Khoroshevskoye shosse and on Levoberezhnaya street all winter from 2014 to 2015 for a year stood without heating. And in some houses the roof and sealing of interpanel joints were not executed. How can one appreciate the fact that in these houses interior cosmetic finishing has already been performed - the ceilings are whitewashed and the wallpaper is hung? Well, the wallpaper can be re-glued, but the main problem is that the water that has penetrated into the interpanel joints and cracks in reinforced concrete structures is a destructive force, especially in winter.
The situation was aggravated by the fact that SU-155 by August 2015 became financially untenable and curtailed all construction and installation work, not fulfilling its obligations to the customer of GUOV. In September 2015, the General Director of OJSC “GUOV”, Timur Ivanov, during a meeting of the Public Chamber, stated that the organization he heads undertakes to complete the construction. In October, this organization began work already in the role of not a customer, but a general contractor.
SUCH UNBELOCIOUS LEFT BANK
The representative of the Bezdomny Regiment initiative group, who introduced himself as a Nikolai to the NVO correspondent, described the current situation, using the example of a neighborhood on Levoberezhnaya Street. Since the Ministry of Defense doesn’t have money to complete construction work at the specified facility, the subcontractor minimizes the work here. But even in those buildings where sanitary plumbing and drainage systems already exist, there is no way for these communications to reach the city network.
In February, the 2014 of the year, the Main Military Prosecutor’s Office conducted an inspection of the construction of SU-155 at the above facilities and concluded that “the constructed and distributed housing has no permanently connected engineering communications and is built with violations”. Since the executor of these works, the subcontractor of IC INZhSTROYBETON LLC, terminates its activities at this construction site due to lack of funding and transfers people and equipment to another object. To the outrage of the future residents of this microdistrict, the construction foreman said that before transferring money from the GUOV, nothing would be done on the Left Bank. Until the end of July, the delivery of four houses was planned. Five more buildings - №№ 2, 5, 6, 7, 8, according to the schedule, should be completed as soon as possible, but there is no money and the work is stopped. It turns out that those houses that still surrender will become hostages of a temporary sewage system, with which anything can happen during the winter period. To top it off, it is not known where the drain of the storm sewers is organized. It is possible that rainwater is discharged into the sanitary sewer. If this is so, in case of unexpectedly heavy rainfall, the residents of the microdistrict are threatened not only by the flood, but also by flooding with the contents of the sanitary sewage system.
You do not need to be an expert to assume that in winter the storm drains will again become a problem of unfinished houses, in which work has now been stopped. These buildings are still not preserved, and still not all of them have roofs covered with roofing materials, waterproofing of interpanel joints and seams is not always performed.
In houses where there is a roof, because of the lack of heating, drains are defrosted in winter, and they are laid in structures of this type inside a thermal circuit. That is, the water frozen in the gutters breaks down the storm pipes, then during thaws and during the rains it spreads throughout the entire structure of the house. Under the influence of this phenomenon, all the structures of the house gradually begin to collapse. Solving this problem, the builders went for temporary measures, the storm runoff was brought out through the open windows of the upper floors. Well, we can congratulate the general contractor with this "brilliant" engineering solution.
HISTORY OF COLONEL Davydov
There are a number of sensitive issues that require coverage. When permanent housing is allocated to servicemen of the Ministry of Defense, the area of the apartment provided is determined in accordance with the internal regulatory documents, based on the position and rank of the waiting list. When fired, servicemen surrender a service apartment and remain without a residence permit (or temporary registration) until the moment they receive permanent housing. For this period, social benefits are no longer available: medical care, placement of children in schools and preschool institutions, and receiving electronic debit bank cards. Sometimes the Ministry of Defense easily waives its obligations. In this aspect, the story of Colonel Igor Borisovich Davydov, in the recent past, the senior officer of the Main Automobile and Armored Directorate of the Ministry of Defense is indicative. In 2008, he was taken out of the state due to his retirement age. In 2009, he fell into the category of so-called disposition. In 2010, there was a decision of the military garrison court to provide him with extraordinary housing. Then the housing commissions were eliminated, the rules for providing housing to servicemen were changed. In the newly formed Department of Housing, he was informed that the decisions of the court and the housing commission no longer have any meaning, and he was put in a general queue in accordance with the new standards, according to the date of registration of the application with the JO.
In 2014, reserve colonel Davydov became an invalid of the 3 group. In accordance with the departmental documents of the Defense Ministry of the Russian Federation - within a month after the military-medical commission (IHC) recognized the serviceman unfit for military service, he should be dismissed from the Armed Forces with housing. Davydov appealed to the prosecutor's office with a complaint that JO did not execute the decision of the military garrison court and the order of the Defense Ministry, delays the process of providing him with permanent housing, which lasts for six years. The result is the same.
Igor Borisovich was lucky to talk on the phone about his problem with the head of 2-rd administration, JO Kuznetsov. COMMENT OF THE MINISTRY OF DEFENSE OF RUSSIA

In 2015 – 2016, by attracting its own and loan funds, GUOV JSC completed all the necessary work to commission residential buildings on ul. Bolshaya Ochakovskaya (10 cases on 1796 apartments, settled on 90%). Also, "GUOV" on its own passed four buildings in the neighborhood "Molzhaninovo", four buildings on the street. Left Bank and Khoroshevskoe highway.
At its own expense, “GUOV” completed the preservation of unfinished buildings, which made it possible not to freeze the water supply and heating systems, paid for the technical connection of new buildings to the city networks, and repaid the debts of SU-155 Group to resource organizations.
Currently, JSC "GUOV" continues to work on the maintenance of unfinished buildings. In determining the rate of housing provision, the department is strictly guided by the requirements of Russian legislation, which clearly regulates the provision of additional square meters. After being dismissed from a teaching or research position, such servicemen lose the right to an additional total area of the dwelling. This legislation has been repeatedly supported by the courts, including the Supreme Court of the Russian Federation.
Moreover, according to the definition of the Constitutional Court of the Russian Federation, the right to receive additional living space is a privilege granted to citizens, taking into account their special legal status. And the termination of this legal status presupposes the loss of the right to privilege, but does not violate the rights of servicemen.

Moreover, the housing authorities go to meet military personnel and give the right to live in office housing from two to four months after providing permanent housing for the possibility of arranging, repairing and moving to new housing.
The Department of Housing has not received a single appeal, including from the prosecution authorities, to violate the rights of servicemen during the delivery of official housing.
On the issue of the size of the housing subsidy, it should be noted that this form of housing allowed us to speed up the process of providing housing. Thus, since August 2014, housing subsidies have already received 16,4 thousand troops, totaling 90,1 billion rubles. In addition, due to the profitability and efficiency of the housing issue, 12 thou. Thousand soldiers changed the form of security from an apartment to a housing subsidy.
The existing approach to determining the size of a housing subsidy allows a soldier to purchase residential premises according to the standards established by law in all regions of the Russian Federation, including new buildings in Moscow.
At the same time, in many cities a soldier will be able to purchase a dwelling for the specified amount of housing subsidies, the area of which will be higher than that granted to him by the norms of provision.
In 2016, the Ministry of Defense of Russia provides permanent housing to military personnel from all forms of security, including in-kind apartments, housing subsidies, state housing certificates (SHC), as well as through an accumulative mortgage system (NIS).
The Russian Defense Ministry decided to bring all the houses under the previously concluded contracts to the time of settlement and no longer build new houses, which means that the houses that had been started earlier with construction will be completed and transferred to servicemen. In the future, the decision to provide housing for military personnel will be carried out through other forms of provision: housing subsidies, the SHC and the savings and mortgage system.
Taking into account the current laws of the Russian Federation by 2028, the savings and mortgage system will become the main way to provide permanent housing for servicemen.
