The International Criminal Court in The Hague (ICC) refused to initiate proceedings on the facts of civilian deaths in the unrecognized republics of Donbass due to the fact that the circumstances stated in the statement do not fall under its jurisdiction, the newspaper reports Look.
“The court can only exercise jurisdiction over international crimes if (I) its jurisdiction was recognized by the state in whose territory the crime was committed, (ii) its jurisdiction was recognized by the state of the accused person, or (iii) the situation is transferred to the prosecutor Security Council, acting under Chapter VII of the UN Charter ",
the ICC prosecutor’s lawyer Igor Trunov said in an official response.
The prosecutor noted that “none of the conditions is fulfilled in relation to the situation described, the alleged violations do not fall under the jurisdiction of the court”.
At the same time, he said that the received "information is stored in the court archives in case the conditions change."
Last January, Igor Trunov reported that “a statement about the investigation into the facts of crimes against humanity committed by officials of Ukraine was accepted for consideration (by the court in The Hague) and communication was started on it”.
