What awaits disrupting the execution of state defense orders?
“Excommunication” expects those company executives who violated the terms of the contract in the performance of the state defense order and caused material damage to the state in the amount of at least 5% of the total amount stated in the contract. In monetary terms, 5% is at least 5 million rubles. Does it follow from this that if the company assumed obligations to fulfill one or another contract, but disrupted implementation, causing damage to the state treasury, for example, 4 million rubles, then the company’s management would be disqualified (and this is the term used Dmitry Rogozin) is not threatened? Unfortunately, there are no such details yet.
But it is known that the disqualification of inefficient managers (or fully companies) from the scope of the GOZ will not be "lifelong." The deadline is 3 of the year. Apparently, during this time the manager somewhere will increase its efficiency and come to the state defense order with new forces, new ideas and an indispensable desire to fulfill contractual obligations ...
Meanwhile, a meeting with vice-premiers was held in the Cabinet of Ministers, which was devoted, among other things, to the implementation of the state defense order, namely, the provision of state guarantees for loans to defense companies participating in the GOZ. Prime Minister Dmitry Medvedev at the meeting stated that state guarantees by the defense industry enterprises are work that is an integral part of the implementation of the state program of re-equipment of the Russian army. For only one 2014 year, according to Medvedev, the state has provided guarantees for an enormous amount of 377,8 billion rubles, which should be a significant help in finding funds from extrabudgetary sources for 62 enterprises from the field of defense industry, working with the state defense order. The total number of state guarantees is 96.
State guarantees - in this case, it is a tool that a company can receive as a financial basis for the possibility of taking a loan in commercial structures. That is, commercial organizations involved in lending, must be sure that the company will reimburse the allocated funds with interest. And the state is ready to instill such confidence in the business structure today.
377,8 billion rubles is a record since the start of the state support program. According to Dmitry Rogozin, who for obvious reasons was also present at the meeting, the dynamics of financing looked as follows: 2011 year - state guarantees in the amount of 122,5 billion rubles, 2012 - about 188 billion rubles, 2013 - 362,27 billion rubles.
At the same time, Rogozin emphasized that the growth in the volume of state guarantees in terms of support for enterprises participating in the implementation of the state defense order is associated with the growth of the state armament program. So, by 2015, based on plans, the rearmament of the army and fleet RF should be at least 30%.
You have already signed the first decree, now we have the second decree worth 42,63 billion rubles in our work. Apparently, there will be another third and fourth, that is, during the year on the readiness of the loans themselves prepared by credit organizations and enterprises of the military-industrial complex.
According to statistics, the more funds for solving a particular issue are allocated from the state budget, the more these funds can go through corruption-fraudulent schemes. In this regard, against the background of the positive dynamics in the provision of state guarantees to defense-industrial complex enterprises, one should not forget about such an important component as full control of allocated funds. To what extent is reinforced concrete ready to control the state in this sector? - so far a big question.
At the moment, there are considerable concerns about the fact that a substantial part of the allocated financial guarantees may in a materialized form dissolve in the pockets and accounts of those who have chosen the GOZ as a means of quick and large-scale fraudulent earnings. Such concerns arise, if only for the reason that the other day the Chief Military Prosecutor Fridinsky announced the extent of non-compliance with the GOZ and other violations in the field of work with the state defense order. Fridinsky noted that 90 contracts in the defense industry were broken only in 2013 year. At the same time, the total amount of debts of defense companies to the budget of the Ministry of Defense amounted to 60 billion rubles. 90 contracts are broken in 2013, 96 state guarantees are highlighted in 2014. Similar arithmetic ...
I would like to hope that in the near future government officials will line up in such a way that in the process of implementing the state defense order, full control will be exercised, and those guilty of disrupting the execution of contracts will be punished, which would once and for all discourage the desire to launch a hand in a jug with dedicated security countries budgetary funds.
It is unlikely that a three-year disqualification from the GOZ system and suspended sentences practiced today without a hint of confiscation of property can be such a punishment.
