One day, on a clear day, Muscovite Maria Shakirzanova, along with her daughter Eva, came to the passport office in Tagansky District — some documents had to be issued. While I was driving from Novokosino, while I was standing in line, it was time to feed the girl. Eve is a year and three months old, but she is still breastfed. Maria asked the passport to show her where to feed her baby and change diapers.
Then the thriller began. A few minutes after the conversation, an outfit arrived at the passport office. The police immediately took away the child, accusing the young mother of vagrancy - only on the grounds that she did not have a baby's passport and birth certificate. Maria explained that she wanted to issue a certificate to her daughter, showed even a birth certificate issued at the maternity hospital — it did not help. Then the woman asked for permission to call home, notify her mother about what happened. Not allowed.
As a result, Maria and her daughter were taken to the police station. There they shouted, humiliated, examined their hands - they were looking for traces of injections. My daughter kept crying, Masha was never allowed to feed her. The woman was shocked. She simply did not understand some questions.
“Masha, as a child, stuttered a lot, she is lost and locks in herself when her voice is raised,” her mother Natalya Matveyeva told Culture. - To overcome this ailment, we even sang in the family for several years, and did not speak. She recovered normal speech, but in a stressful situation, she is completely lost.
It must be said, Masha is a believer and not too secular, in her 26 she sometimes makes an impression of a naive simple-minded person who is not oriented in the surrounding life, especially in the intricacies of legislation. That is why, like hundreds of other Orthodox, she did not receive a new passport with a bar code. However, after clarifying the church hierarchs, she realized that her concerns were in vain, and decided to undergo certification. But here is a new problem. The only document Maria had was a birth certificate. She always carried it with her and eventually lost it. In the Orthodox charitable organization “House for Mom”, they helped solve this problem: they sent a request to the registry offices, and a duplicate certificate came to the very center for rendering public services, where the passport office is located and from where Masha took the police squad.
“At half past four in the evening, when Masha and Eva should have been at home a long time ago, the phone rang unexpectedly,” recalls Natalya Matveyeva. - The lady introduced herself as an inspector of the Department of Internal Affairs Mylkina and said that, they say, a certain girl claims that she is your daughter. Then I heard Masha's inhuman cry: “Eve is taken away from me !!!” I begged the inspector to wait until I brought the documents that the baby was breastfed, had a number of diseases, he should not be separated from her mother.
Natalia rushed into the Department of Internal Affairs, but it was already too late: the girl was sent to the orphanage No. 6 on Pyatnitskaya. Maria fought hysterically outside the ATS gate. She was not even given any document that a child had been taken from her. It happened, I must say, just December 31 - but what's the New Year here. All the following days, while the country was celebrating and resting, Maria and her mother went to the ATS, the guardianship authorities, the orphanage every day, as if at work, sobbing and begging for Eva to be returned to them. In response - silence.
“It seemed to me that they were just mocking us,” Natalya Matveyeva recalls with tears. - For example, they told me that my daughter was found in a snowdrift, like a bomzhihu. But still remember that in December there was no snow in sight!
Silence or vigilance?
When family lawyers requested official documents for which they had taken the girl, they were shown the act of identifying a street child. It was compiled by juvenile inspectors and signed by representatives of the guardianship authority. Here, according to this piece of paper, drawn up in half an hour, Eve was taken from her mother.
Neither the mother nor the grandmother to the baby was not allowed for three weeks. They wrote complaints to all instances, even appealed to the State Duma. Eve was able to return only after an official statement about the kidnapping of the child, which her mother and grandmother carried directly to Petrovka. But even after that the girl was not immediately given away.
“In the House of Child, documents from the guardianship bodies demanded of us that we could give it to Eve,” recalls Natalya.
Now Maria does not let her daughter down for a minute. It seems that for her nothing more and no one exists. The woman looks frightened, hunted. But she is not afraid for herself, for her daughter - will she be able to recover from her stress?
“Eva was always calm,” says the young mother. - And now she started screaming at night, crying. And for some reason, beats the sofa - it seems that she was punished. What we have experienced is hell.
A modest young woman, not rich, but decent, seasonally dressed. The well-groomed baby, already goes for a handle, says the first words. Examines pictures in books. With pleasure nibbles an apple. Near grandmother, not parting with the prayer book. At home, children's toys coexist with icons. It is a decent Orthodox family. What did not like the officials?
At the passport office, we were commented on the situation by phone: they say that while staying there, Maria said that she had a falling out with her mother, and she had nowhere to go. She behaved strangely, and the girl is not at all like her. I decided to go there, find out in more detail what had happened - it did not fit in my head, that all of a sudden, you could take and take away the child. The center is located not far from Proletarskaya metro station, on the first floor of a residential building. Spacious room, polite employee. There is also a “Mother’s and Child’s Room” where you can feed and swaddle your baby.
“If you need to use it, then please,” the employee warmly suggested.
But as soon as they found out who I was and for what reason I came, the attitude immediately changed. A smiling employee suddenly declared that she wouldn’t talk without a boss. And the authorities, as usual in such cases, departed on business.
However, I understood the motivation of passportists and Interior Ministry officers: weird mother, there is no complete set of documents, and indeed, they wanted the best ... And then stop. Yes, unusual, no documents - also true. But is it a reason to select a child? Is it better for him to be in a government house, and not at his mother and grandmother? And if this is how the soul hurts the law enforcement officers for the fate of the baby, then why not round up the police car with a flashing light to Masha's home - see what conditions the girl lives in. No, they didn’t even think about making extra gestures.
The Department of Internal Affairs refused to comment on the situation at all - an official check is now underway. The department of social security reported: "The family of M. A. Shakirzanova will be accompanied by a department of guardianship, guardianship and patronage at her place of residence in the Kosino-Ukhtomsky district." In the orphanage no official response was given. But they did not officially say: they say, there is a mistake - it happens to anyone
Lawyers believe that everything that happened to Maria is legal lawlessness. After all, Eve was registered at the orphanage as a street child, although she was with her mother. And the documents that my grandmother brought were not even looking.
“In my opinion, police officers illegally detained my client,” says lawyer Shakirzanova Irina Chepurnaya. - From the passport office, where she came herself, she was transported to the ATS. On what basis? The juvenile affairs officers conducted an interrogation, also without good reason. Maria was not allowed to call her relatives, they did not allow us to invite a lawyer, her constitutional rights were violated. At the Tagansky ATS, we have not been given an explanation so far. Police actions can be qualified as kidnapping and abuse of power.
However, there are legal grounds for those who chose little Eve, no matter how monstrous. The Constitution, human rights, the centuries-old tradition of protecting and protecting the family, motherhood and childhood - all are crossed out by article 77 of the Family Code “Taking a child out of an immediate threat to a child’s life or health”. It turns out that the guardianship agencies have the right to take the child without any trial. It will seem to someone that the health of the baby is in danger - and that is enough.

The juvenile justice machine is increasing momentum. This is a legalized technology for removing a child from a family under the pretext of protecting his interests. Here and there, there are reports that children are taken away from their parents. Left the house without documents - there is a reason to take the child. Because you cannot prove that it is your son or daughter. Maybe you stole it to sell it to the organs - there is a threat to the life of the child, art. 77 Family Code. Do you have a birth certificate? Perfectly. But it will not help. There are no photos. What if you stole the neighbor's son, something he does not look like you. And again 77. Under the wheels of this car can get any. Here are some examples.
Muscovites Dasha and Maxim Efremov, raising two family daughters, also took a couple of foster children from the House of the Child - Kohl and Vanya. And though the kids suffered from serious illnesses, they were the most beloved ones. My father has a small business, my mother was busy with children, on weekends the family often arranged holidays for neighbors. Apartment, cottage, car, and then Dasha became pregnant again. So much happiness and one Ephraim - the disorder.
Somehow people in masks burst into the apartment, the boys were taken away. The reason - the complaint of neighbors that the children in the family ... are being smothered. Ephraim was threatened with prison, and their own daughters - orphanage. Now Daria and Maxim are looking for selected boys in orphanages. Kohl managed to find, but it does not return. About strangulation is no longer remembered - it is clear that nonsense. But there is a more serious problem: it turns out that Dasha and Maxim did not take courses for adoptive parents, so you cannot trust the child to them, despite the fact that he has lived well in this family for two years now. And the fate of Vanya is not known.
Another case. A few years ago, a resident of Ivanovo, Andrei Vershinin, lost his wife, left a little daughter, Sonya. Soon he married a woman with a child. Snezhana took Sonya as her own, changed her wet sheets — the girl has enuresis. Another baby appeared in the family. But on one, not at all wonderful for the family, Sonya was stolen by her grandmother, the former mother-in-law. The reason is simple: after the death of the mother, the girl became the heir to a large apartment in the city center. Return the child until it turns out. All courts in Ivanovo lost, came to seek the truth in Moscow.
“They fabricated a case against me that I beat Sonya,” says Snezhana. “Although the youngest child got sick the day before, there was a doctor in the house, and at the same time he examined Sonya, he did not see any bruises. Examination lime, a pair of bruises have any child. But the prosecutor does not want to listen to anything. And the husband was accused of not feeding and dressing the girl. For two years now we have been judged to return the baby, and we are not even allowed to see her.
Maria Kazimirova and Artem Rashitov may become the next orphaned parents. They are not Muscovites, but they have been living in the capital for a long time; they have registration, pay taxes and a “communal flat”. But here are no benefits on which permanent residents of the First Throne can count, they are not supposed to. Not built kindergartens for visitors. A group of parents, including Mary and Artem, signed a petition on the inaccessibility of preschool education. Immediately, representatives of the guardianship came to visit them: they say, there is no possibility to give to kindergarten - we will help: we will take them to the shelter.

From families that for one reason or another fell into a difficult life situation: lack of repairs, lack of funds, low salaries, temporary housing difficulties. In a family, children are better
Since ancient times, the prosperity of the family was based on the traditional spiritual and moral basis, confirmed by the centuries-old experience of our ancestors. Its destruction will lead to negative changes in all spheres of society. At the XV World Russian National Council in May 2011, the family was recognized as a base value.
Yes, there are families from which it is simply necessary to pick up the child, but this is the exception rather than the rule. "Lost Sheep" must be saved - to help with kind words, advice, and sometimes money. History, with which we started the story, occurred, I recall, in the Center for Public Services. Normal such public service is to take the child to the orphanage. But to help the family in a difficult situation - it turns out that the state does not have such a service.
The opening of the Orthodox Crisis Center in Moscow Yes, today in Moscow there are several crisis centers to help women in difficult situations, including the ROC. There, victims of family conflicts with a child can find shelter, a table, and clothing, as well as moral support and solace, which is necessary during an argument. But this is a drop in the ocean.
A large family is immediately in the risk zone. Here the income per person is much lower than in the cells of a one-child society. In addition, children in such families are often foster. As officials say, not parents, but state ones - it is even easier to pick them up.
The officials do not understand that the child cannot calmly transfer the separation from his parents, even adoptive ones, not to mention his relatives. In the Arkhangelsk region, the guardianship bodies have selected three daughters from a divorced mother. The girls were so hard upset that the elder hanged herself in less than two months apart.
Who is guilty? An alcoholic father who left the family or a mother who works day and night to feed her daughters? Or maybe all the same official, who decided the fate of the family with one stroke of the pen?
Guardianships have become a punitive system. The trauma of losing parents is much more painful than a bruise, which can take them to an orphanage. No porridge with butter in the state-owned catering department can replace tea with crackers in a native shabby kitchenette.
“Even if mother and father drink, children and with such parents are better than in separation,” Head of the Department for the Coordination of Juvenile Affairs of the Ministry of the Interior of Russia, Police Colonel Elena Novoseltseva, expressed her view of the problem to Culture. - Or it happens that a teenager goes to work to support his younger brothers and sisters. Under article 77 of the Family Code, we can send it to an orphanage, and the younger ones to the orphanage, but why destroy the family?
It turns out that the law is law, but it must be approached with a mind and a kind heart. What do not always understand the various officials.

It all started with the initiative of American social activists of the late XIX century. They suggested that the authorities not to apply criminal sanctions to minors, but to transfer them for correction under the supervision of the trustees. At the same time, special children's courts appeared in the USA and in Europe. In Russia, by the way, too.
We have child justice ended in 1917 year. And abroad, juvenile justice has evolved, and now its main principle: a non-child child has the same rights as an adult. In fact, this establishes the priority of the rights of the child over the rights of the parent - the refusal of parents to fulfill any, even the most extravagant whim of the child is recognized as a violation of his rights.
The first step in implementing the principles of juvenile justice in our country was the new Family Code of the Russian Federation, adopted in 1995. It contains the child’s right to declare to the parents in the guardianship and custody agency, and upon reaching 14 years - to the court (Art. 56). And the guardianship received the right to remove the child from the family.
Juvenile justice is being actively introduced in Russian cities. In Yekaterinburg, a “children's advocacy” has been created, where children can claim violation of their rights by parents or teachers. In schools, complaint boxes appeared, they were called "Pavlik Morozov's boxes".
This is how juvenile justice works, for example, in the Tula region. A ten-year-old boy got in touch with a bad company, didn’t spend the night at home and, in general, of course, got a belt. This is obvious. The next step is unbelievable: my father was fined five thousand rubles and warned that the next time he would be deprived of his parental rights.
However, we are far from the West. Suffice it to recall the sensational story of actress Natalia Zakharova. She was separated from her daughter Masha, who at that time was only three years old. The Juvenile Court of France selected the girl under the pretext of the so-called “suffocating love” from the mother. But, we are moving, it seems, in the same direction.
Interestingly, our tutors are trained by Finns. They have a lot of experience: annually in this small country, juveniles are taken from families up to 10 000 children.
The reason for family tragedies lies in the fashionable Westernist legislation in the 90, which allows for extrajudicial seizure of children, and for subjective reasons. And in vicious practice in some regions, the implementation of which these laws allow. In the same place where managers have even a drop of common sense, the ridiculous anti-family laws remain nothing more than letters on paper.
In 2013, the reform of family law began - more than 30 amendments were adopted. Thus, for Russians, the process of adopting orphans has been significantly simplified, additional measures have been introduced to support adoptive parents who are ready to take an orphan into the family, the provision of medical services has been revised in the interests of children. Now the State Duma Committee on Family, Women and Children is trying to solve one of the most pressing issues - to eliminate bureaucratic lawlessness in cases when it comes to removing a child from the family. It is planned to introduce a bill to make it possible only by a court decision, and not in the way it is now - on the initiative of social services employees on the basis of an act of a local government body.
If you do not change anything, the situation can reach the point of absurdity. The teacher made the lessons teach? Mom did not let the disco? Yes, this is child abuse. Parents - fine, child - in an orphanage. By the way, one million rubles a year is allocated for the maintenance of one pupil there. Not every son of the oligarch falls such content.
