Vasilyeva may be credited with house arrest within the term of the sentence, and Serdyukov was left one case
The press continues to discuss the prospects of the cases of the former leaders of the Ministry of Defense of the Russian Federation. According to the media, the main person involved in the case of Oboronservis Evgenia Vasilyev can avoid the colony - even in the case of a conviction, it is likely to be credited in time spent under house arrest.
As for the former defense minister, Anatoly Serdyukov, with whom Vasilyeva, according to her recent confession, had a personal relationship, he is also unlikely to be imprisoned. According to the lawyer, a new case against him that threatened with a colony will not be initiated.
As the Moskovsky Komsomolets newspaper writes, if the ex-head of the Department of Property Relations of the Ministry of Defense Vasiliev is convicted this year, then she will most likely not have to serve her sentence. In any case, such a possible development of events is evidenced by the decision of the Supreme Court on the eve, which explains the details of the use of house arrest.
The document states that the time spent under house arrest "in any case should be taken into account in the term of punishment." The issue was considered in connection with the appeal of a Stavropol resident convicted of beatings and attempted rape, who was not taken into account in his sentence time spent under house arrest.
The decision of the Supreme Court can directly touch Vasilyeva, notes MK. According to the newspaper, even if she is found guilty of embezzlement in the Oboronservis case, she will avoid serving the sentence in the colony, since, according to experts, she will receive no more than two years in prison. By the time of the possible sentencing, Vasilyev will be just about as supervised in his luxurious apartment in the capital’s Molochny Lane.
Evgeny Vasilyev is accused of 12 episodes of criminal activity related to the sale of real estate by Oboronservis, theft of funds of an organization - fraud committed by an organized group on a large scale, abuse of authority, abuse of power and money laundering.
According to the investigation, the organized criminal group, of which Vasilyeva was a member, also included Irina Egorova, Larisa Egorina, Yuri Grehnev, Maxim Zakutaylo, Dinara Bilyalova and Ekaterina Smetanova. Defendants are charged with 36 crimes, and the damage, according to the investigation, caused by their actions, exceeds three billion rubles.
Lawyer: no complaints about the sale of Rosleskhoz lands to Serdyukov
Meanwhile, lawyer Anatoly Serdyukov Konstantin Rivkin told the newspaper "Izvestia" about what is happening with his client. According to the lawyer, investigators are not going to initiate a new case against the ex-minister about the sale of the Rosleskhoz lands, which the press has previously written about.
According to Rivkin, the accusations against Serdyukov under Article 293 of the Criminal Code (negligence) related to the improvement of the Zhitnoye recreation center in the Astrakhan Region will be final, and the investigation has no other claims to the former defense minister. Currently, Serdyukov is studying the materials of his criminal case, daily reading one by one, said the lawyer.
Earlier, the newspaper Kommersant wrote that Serdyukov could be accused of violations when selling 140 hectares of forest land in the Krasnogorsk district of Moscow region, which had previously been a testing ground. In July, 2013, the Main Military Prosecutor's Office, after conducting an inspection, recognized the transaction as illegal.
If Serdyukov remains the person involved only in cases of negligence, then he, most likely, as a person who "took part in hostilities or in actions to defend the Fatherland", will fall under the amnesty announced by the State Duma in December. According to Rivkin, lawyers have already decided on a legal position on this issue, but so far they have not discussed the issue with Serdyukov in detail.
