The territorial office of the Federal Property Management Agency for the Krasnodar Territory asks to recognize the right to the site for the Russian Federation. The first hearing on the merits of the suit is scheduled for January 15 of 2014 of the year. In turn, the Military Prosecutor's Office of the Southern Military District filed another lawsuit in the court, suggesting that the deal be invalidated, under which the rights to land, garage, gatehouse and summer house were transferred to City Engineering. A hearing on this claim by the prosecutor will commence on December 11. In both processes, the defendant objects to the claimed lawsuits, the newspaper writes.
According to the investigation, in July 2010, Minister of Defense Anatoly Serdyukov appealed to the Anapa administration with a request to transfer the Department of Property Relations to the department, which was then headed by the main person involved in the case of Oboronservis, Yevgeny Vasilyev, a plot of land in Great Utrish. On the plot was planned to build a radar station.
The land was transferred to the Ministry of Defense and a month later it was transferred to the unitary enterprise "District Material Warehouse of the Moscow District of the Air Force and Air Defense," and then was included in the authorized capital of the eponymous company, which was managed by another person involved in the Oboronservis case, Maxim Zakutaylo. Soon the site was recognized as a non-core asset and through the legal support center Expert, managed by Ekaterina Smetanova, was sold to City Engineering LLC for 110 million rubles - by 57 million rubles cheaper than the market value.
“In August, the Minister of Defense Anatoly Serdyukov addressed the administration of Anapa in 2009 with the request to transfer to 93 for free use weave land on the territory of the Bolshoi Utrish recreation center. The mayor of Anapa Tatyana Evsikova and the municipal council of the city transferred the summer house to the Ministry of Defense free of charge recreation centers, "- wrote the newspaper" Izvestia ", citing its own informed source. Soon, according to available data, construction began on the territory. According to rumors, it was the radar station that was being built, but it looked strange - the site was in a lowland, which dramatically reduced the effectiveness of the radars. But in the end, no military facilities in the area were ever built.
The case was opened in February of this year according to part 4, item 159 (fraud committed on a large scale) and part 3 item xNUMX of the RF Criminal Code (abuse of official authority, which caused grave consequences). It was reported that the investigation allegedly had evidence of the involvement of the former Minister of Defense Anatoly Serdyukov in the scam with the land near the Black Sea - as it was established, he personally signed the documents on operations with this section.
Defense Ministry is suing for yet another "cottage Serdyukov"
In the Krasnodar Territory, the arbitration since March 2012 of the year is considering another lawsuit filed by the Federal Property Management Agency against City Engineering LLC, with the participation of the Defense Ministry regarding another land plot in the village of Peresyp, Temryuk District. This site on the coast of the Azov Sea in the press was also called the "Serdyukov dacha". The Federal Agency for State Property Management believes that the rights of the Ministry of Defense for real estate are not confirmed, and the military require the site at their disposal, writes Kommersant. According to the newspaper, the parties are currently discussing a settlement agreement.
According to investigators, this site with an area of more than three hectares, as well as land on the Black Sea coast, was sold to City Engineering LLC by Ekaterina Smetanova and Maxim Zakutaylo. As the media wrote, at first the Ministry of Defense was going to build a sanatorium for the military, and then a cottage settlement with luxurious buildings, a pool, a park, a pier and a helipad grew at this place. Then the military department sold the complex for more than 300 million rubles for just 92 million.
