The Ministry of Defense proposed amendments to the law "On Military Duty and Military Service"

The Defense Ministry proposed to amend the federal law “On Military Duty and Military Service,” according to which, the commanders will receive the right to dismiss subordinates in a simplified manner for the use of alcohol, drugs, misbehavior, corruption, and the disclosure of proprietary information (without secrecy), reported News.

The Ministry of Defense proposed amendments to the law "On Military Duty and Military Service"

Currently, the amendments are being coordinated with the security agencies, which provide for military service.

“The Defense Ministry plans to start small - to clarify the sub-paragraph" e1 "(on" violations of prohibitions, restrictions and obligations related to the passage of military service ") with the phrase" established in order to combat corruption. " And also to add to this article two new independent subparagraphs ("e3" and "e4"): "in connection with the commission of an act discrediting the honor and dignity of a soldier" and "in connection with the disclosure of proprietary information". After that, the command will proceed to the main work, ”the newspaper writes with reference to the Ministry of Defense.

Now, to dismiss a soldier, you need to prove that he has repeatedly violated the terms of the contract. One of the conditions is the presence of several disciplinary actions. In this regard, the process of dismissal is delayed for months. The amendments proposed to eliminate this legislative gap and give commanders the right to dismiss the guilty in a simplified manner.

There are already rules on dismissal in Russia for disclosing proprietary information or discrediting honor and dignity. This type of punishment for civil servants is provided for in the law "On the State Civil Service in the Russian Federation." For unworthy deeds, employees of the Ministry of Internal Affairs can be fired. And these norms are not actively used in practice for the first year,
Igor Simonov, a lawyer at the Knyazev and Partners Moscow Bar Association, told the newspaper.

According to the head of the working group of the Council under the President of the Russian Federation on the development of civil society and human rights on the protection of the rights of servicemen Sergey Krivenko, “in the model contracts for servicemen there are many references to the statutes and federal laws regulating the life of the army, but few specifics”.

The concept of "an act that discredits the honor and dignity of a soldier" should be clearly described in the legislation, making an exhaustive list of such violations. The statute does not specify which actions can be considered as such. This concept can be interpreted in different ways. The same goes for the service information item. There were cases when higher-level commanders regarded complaints of soldiers and officers to the military prosecutor’s office in the following way:
told Krivenko.

the broadest field for abuse ...
Now, in order to dismiss a soldier, you need to prove that he repeatedly violated the terms of the contract. One of the conditions is the presence of several disciplinary sanctions.
For a Gross violation, you can immediately dismiss .... and as a matter of fact it is proposed to give the commander the right to dismiss ANY misconduct ....... that's where the bacchanalia begins.

Apparently the military prosecutor’s office will have to determine the degree of sufficiency of “drunk” and “disclosed” allowing the serviceman to dismiss, and in the absence of normal explanations (and they are simply obliged to appear) it will be very difficult to objectively do these articles.

And this is generally an ideal way to prematurely terminate the service, if not replaced by serving in a disbath or forced labor.

Alas, the military as in the movie "Officers" is getting smaller.
Many do not go to defend their homeland, but because:
              - there is no work in the province.
              - I can’t do anything else.
              - material benefits.
-the desire to attach a fifth point to the megapopular today’s law enforcement agencies.
              and so on.

However, there is a twofold feeling, on the one hand, and less bureaucracy, and on the other hand, if the commander of the tyrant starts to the left to expel all those who disagree with him, then what would happen would not be in a hurry, it would be a case when you hurry in no hurry. Yes

The “simplified order” can lead to the emergence of an instrument of pressure on those who disagree, interfere, impede and other “white crows”, as well as “follow the power” of the followers of Vereshchagin. Although the rationality in the idea is great - there are a lot of people insolently using the difficulty of the dismissal process. Such things must be introduced very deliberately, gradually and provide for an appeal system ...

Think right in MO. The commander is the same subordinate, but also responsible for all and for everything, and can also fall under the distribution. Weapons in the troops are becoming more and more powerful and expensive. Performance and its capabilities are growing day by day. Drunk, stoned and undisciplined brains can’t stand next to such weapons, but nothing to control them. Who does not know or forgot to remind. Putin, in the second, military part of his message, announced an ultimatum to the Saxon Saxon. Draw your own conclusions. MO makes them in the right direction and it pleases.

In general, in this situation there is a violation of the principle of authority.
