Well that's all. The career of a recently unsinkable and eternally conditional provocateur and a merchant from the policy of Navalny seems to be ending very soon. And his fate remains only two options for development. Or, on the basis of the superhuman (to Navalny) Russian laws, this citizen must go to places of deprivation of liberty in order to actually serve the canceled suspended sentence. Or, having received a conviction in the third criminal case, remain conditionally convicted and thus confess to having high patrons who did not allow Navalny to go to prison even with the third proven crime. So, the alternative is not great: either you leave for a couple of years to see the brother you have planted in the Mordovian camps, or you are the most that goat provocateur, who knows his impunity and pushes hundreds of people, including children, to commit crimes.
The fact is that the billionaire and public figure Alisher Usmanov stated that he is not a criminal and the crime stipulated in part 5 of the article 291 of the Criminal Code of the Russian Federation (giving a bribe to an official on a large scale. Term: from eight to fifteen years), did not commit. And, accordingly, filed a lawsuit for the protection of honor and dignity, and also submits a statement about the crime against him Navalny, provided for by part 5 of article 128.1 of the Criminal Code of the Russian Federation (Libel, connected with the prosecution of a person in a particularly grave crime). And Usmanov said this because in March, Navalny and the Anti-Corruption Foundation (FBK) released a very expensive (thanks to the sponsors we all know well) the film “He's not your Dimon,” where they told about the sneakers and T-shirts of Prime Minister Dmitry Medvedev and quite reasonably and convincingly at 100 percent found out that Dmitry Anatolyevich Medvedev ... studied at Leningrad State University and had fellow students. This is where the real connection between the “investigation” and the current prime minister ends and almost erotic fantasies of Alexei Navalny begin, fulfilling the order “for Dimona” and aware of the severe need to urgently master the budget.
So one of the fundamental fantasies of twice conditionally convicted Navalny was the thesis (of course, not proven) that the billionaire Usmanov bribed 50 million dollars to Prime Minister Medvedev, allegedly giving him a palace with grounds on Rublevka. Scream was not measured. "Echo", "New" and "Rain", with the support of "Radio Liberty" and "Deutsche Welle", went into a voluptuous tantrum - here they are, corrupt officials and bribe takers billionaire and prime minister! Bulk will not lie! But then a nuisance happened - the citizen turned out to be a lie. Moreover, one hundred percent. See for yourself.
In the Navalny film “He's not Dimon to You”, it is stated that Usmanov donated the alleged Social Development Project, a charitable foundation for supporting socially significant state projects, which, again according to the authors, is affiliated to Premier Medvedev, the house and 4,3 hectares of land in the village of Znamenskoye not far from Rublevo-Uspenskoye highway worth about 5 billion rubles.
“We perfectly understand what this gift means: it is a bribe. There can be no other explanation as to why an oligarch gives someone an estate for 5 billion, ”the FBK’s“ investigation ”said.
And none of the happily applauding did not bother (or did not want) to pay attention to the obvious repeated lies of a citizen of Navalny and his team, who could not but know the following facts. Firstly, the Sotsgosproekt Foundation is not a charity, but a structure that is engaged in, among other things, “commercial services provision activities”. And secondly, the accusation of bribery of Medvedev and Usmanov is based only on one "irrefutable evidence" - some Ilya Eliseev and Alexey Chetvertkov, who studied together with the future prime minister at the university many years ago, run the fund. And this is where their documentary connection with the current head of government ends. This is the only “proof of bribe” that FBK found. That is, according to Navalny, none of Medvedev's former fellow practitioners can do business, charity, or anything other than sweeping the streets, since any of their actions are immediately interpreted as a bribe to the Prime Minister. Funny Yes, if it’s a bottleneck in the kitchen, and not a large amount of publication, but also paid for mass distribution in the network, including bots scrolled on YouTube.
After that, Alisher Usmanov quite lucidly explained that the transfer of the estate on Rublevskoye Highway to the Sotsgosproekt Foundation was a commercial transaction related to the accession of another site to the territory of his country house. According to Usmanov, the estate was intended for his sister’s residence, but she did not live in it, finding the house too large. Alisher Usmanov, from his longtime acquaintance at Gazprominvestholding Ilya Yeliseyev, learned that the Sotsgosproekt Foundation is going to develop a development project near the borders of the site where Usmanov’s house is located. “I’ve been looking for an opportunity to expand my site where I’ve been living for more than 20 for years, so I offered to exchange their lot, 12 ha, for my sister’s lot away from me and with a ready home,” the businessman said. The fund gave Usmanov an empty plot on Rublevskoye Highway with an area of 12 hectares “at a nominal price,” and he transferred to the Sotsgosproekt a sister’s plot and a house. Obtained from the fund plot Usmanov estimates in 50 million US dollars. According to the businessman, the area of 4 hectares transferred to Sotsgosproekt is 15 — 20 million dollars, and the house is 30 million. “So the balance is approximately 50 on 50,” Usmanov said. Where is Dmitry Medvedev here in this deal is difficult to say. Or rather, impossible. Unless, of course, we are not talking about Navalny’s ordered “investigation,” out of habit, having forgotten that he must be held accountable for his words and deeds.
It is also not difficult to imagine the course of a possible trial on this episode, when all documents on this transaction will be presented in court and commented on by its participants. The FBK problem is that, having grabbed one component, Navalny “did not notice” the second part, interpreting the “Donation Agreement” so that it was “corrupt”, well, nice for consumers.
“If Navalny had asked the officials representing the interests of my companies, he would have received a clear answer and wouldn’t need to invent anything,” said Usmanov. The position of the FBK in this case is not too convincing. They believe that "they could not reveal the cards," and Usmanov's phone "they did not have." It turns out that they were able to unearth the most complicated schemes at FBK, but they didn’t find the phones of secretaries, assistants or legal services of Usmanov. Amazing.
However, a citizen of Navalny, sensing that the ground was finally disappearing from under his feet, tried to tell that the information about such an exchange between Usmanov and "Sotsgosproekt" does not correspond to reality. They say, according to the documents of Rosreestr, there was no plot of 12 ha on Rublevka from the Sotsgosproekt Foundation ... Usmanov bought a plot of 12 ha from the companies Lesnoy Dom and Group East West. “And the very estate in Znamenskoye, which we all already know very well, he donated to the Sotsgosproekt Foundation. But, as it turned out, Navalny again, without straining at all, tritely lied, continuing to commit the crime, provided, as mentioned above, by part 5 of the 128.1 article of the RF Criminal Code (slander, coupled with the accusation of a person in a particularly grave crime).
The fact is that this very site, called Lesha “a bribe to Medvedev”, was owned by the “East Invest Group”, with which “Sotsgosproekt” had an agreement on joint development of the site in Uspensky. On this site they planned to build a cottage settlement for sale. Under the terms of the agreement, East Invest Group was to provide a plot, and the Sotsgosproekt foundation would provide funding. Hence the presence in the transaction of several stages and several parties. So, that with the site and the estate, the situation is quite clear and it is not at all in favor of the citizen Navalny and his accomplices from FBK. In any legal proceedings, both civil and criminal, and in any court, both Russian and foreign.
And now, when it became known that citizen Usmanov filed a lawsuit on the protection of honor and dignity against the citizen Navalny and the FBK created by him to the Lyublinsky District Court of Moscow, everything falls into place. It is clear that Alisher Usmanov will win the lawsuit, since there is not a single piece of evidence in the “investigation” of Navalny, but there are a large number of direct accusations of committing particularly serious crimes.
The next step is likely to be a statement from Usmanov about Navalny committing a crime stipulated in the 5 part of the 128.1 article of the Criminal Code of the Russian Federation (defamation, coupled with the prosecution of a person for a particularly serious crime), for which a penalty of “a fine of up to five million rubles or in the amount of salary or other income of the convicted person for a period of up to three years, or mandatory work for up to four hundred and eighty hours. ” But here it’s not even a matter of punishment, Navalny will once again collect another five million fine from gullible idiots, but the fact that it is the commission of a new crime by a citizen convicted (twice) of a crime, including one grave one.
And article 74 of the Criminal Code "Cancellation of probation or extension of probation" states that "if a probate convicted systematically violated public order during the probationary period, for which he was brought to administrative responsibility, the court on the proposal of the authority specified in part one of this Article, can make a decision on the abolition of probation and the execution of punishment imposed by a court sentence. ” As is known, Navalny was twice convicted and brought to administrative responsibility several times, and even served 15 days, but no one even tried to replace him “conditionally” with “realistically.” But this can (presumably) be attributed to the humanity of Russian justice, or, in extreme cases, to a certain inattention or unwillingness to soil oneself.
But, since Navalny is likely to be sentenced by the court for committing another criminal offense, in this case, slander, part 4 of the same article 74 of the Criminal Code of the Russian Federation already enters, which reads: “In case of a probation for a negligent offense or a deliberate offense of minor or moderate severity, the question of the abolition or preservation of probation is decided by the court. ” That is, if twice a probationally convicted Navalny, having committed a third crime during the period of a conditional term, remains free again, he can safely claim to participate in the world Guinness Book of Records. And he can only sign that his high backers, who are in charge of his provocative activities to split the opposition and raise money from idiots, are still in power. Or somewhere very close. There is no third option: either Navalny goes for two or three years to his brother’s camps, or he is a paid provocateur working on some near-power big uncles, seriously covering him and periodically merging his “tasks”.
